EI . <br /> Facts in Support of the Finding: <br /> The potential for Impacts on Sacramento splittail is discussed in Section III.F of the EIR. The <br /> measures above are designed to mitigate impacts on Sacramento splittail. <br /> 1.Impacts on Giant Garter Snake <br /> - <br /> Potential Significant Impact(F.12): <br /> Implementation of the project could result in significant adverse impacts to the giant garter snake. <br /> Finding: <br /> Based upon the analysis in the EIR,creation of aquatic and associated habitat,compliance with <br /> recommendations and requirements of the US Fish and Wildlife Service and California <br /> Department of Fish and Game,pre-construction salvage of individuals,appropriate scheduling of <br /> i h construction, limitation of vegetation clearing and movement of heavy equipment,training of <br /> construction personnel,and appropriate dewatering of wetlands,ditches,marshes,etcand <br /> relocation of aquatic species will make impacts on the giant garter snake less than significant. <br /> ii <br /> The following mitigation measures will mitigate these impacts to below a level of significance. <br /> G <br /> E <br /> Mitigation Measures (Impact F.12): . <br /> (a) Implementation of the approved wetland mitigation plan (see also Mitigation <br /> Measure FI) would compensate for impacts to aquatic and associated habitat(which is <br /> assumed to constitute giant garter snake.habitat)resultingf.om creek realignment. In <br /> accordance with that plan, a total of 39 acres of aquatic and associated upland and <br /> :! riparian habitat shall be created, constituting a 4.5:1 replacement ratio, and shall be <br /> managed as a preserve for biological resources.. i <br /> i; (b)All mitigation requirements for giant garter snake should be in accordance with, and <br /> to the satisfaction of, CDFG and USFWS. Conditions attached to the CDFG Streambed <br /> Alteration Agreement shall be incorporated into the wetlands plan and implemented <br /> accordingly. <br /> ' (c) The followingpre-construction and construction measures should be implemented to <br /> salvage individuals and to minimize and avoid take. These measures should be consistent <br /> with the recently released SIMSCP(Public review draft,dated September 23, 1999). <br /> Construction shall occur during the active period for the snake, between May 1 and <br /> October 1. Between October 2nd and April 30th, the JPA with the concurrence of the <br /> Permitting Agencies'representatives on the TAC, shall determine if additional measures <br /> ii are necessary to minimize and avoid take. <br /> Limit vegetation clearing within 200 feet of the banks of occupied giant garter snake <br /> aquatic habitat to the minimal area necessary. <br /> 33 <br /> r <br />
