Page 77 0 (J 0 <br /> prompted a reevaluation of the list of special status species with potential to occur on the site. Changes in <br /> the list were the result of: <br /> a Elevation of some species to higher.levels in the listing process. For example,species that were <br /> proposed for listing have either been listed as threatened or endangered,or have been considered and <br /> rejected. Additionally,some former candidates for listing on the Endangered Species List have since <br /> been formally proposed for listing. <br /> a Elimination of the multi-leveled system of candidacy for listing on the federal Endangered Species <br /> List Species previously designated as Federal Candidate 2(FC2)are now considered either federal <br /> candidates(those species for which adequate information exists in support of listing,but that have not <br /> yet been proposed for listing). Other former FC2 and FC3 are now regarded as "Species of Concern", <br /> and lack the specific protections afforded listed,proposed and candidate species. However, <br /> consideration of a project's impacts on these species is still warranted. <br /> a Recognition of additional species as warranting consideration as special status species. For example, -# <br /> CNPS listed 14 plant species in San Joaquin County in its 1992 Inventory of Rare and Endangered <br /> Plants. As of 1998 the total was 30 species. <br /> a Taxonomic name changes. <br /> Tables 1 and 2 list all special status plant and animal species with potential to occur on the project site. <br /> The lists are based on information from the U.S..Fish and Wildlife Service(USFWS 1999; see letter in <br /> Appendix C,the California Department of Fish and Game(CNDDB, 1999;CDFG 1999a, 1999b). Of <br /> the species included on this list,only three(California hibiscus, Sanford's sagittaria, and Wrigbfs <br /> trichocoronis)were considered to have moderate potential, at best,to occur on the project site,based on <br /> habitat requirements and documented distribution of the species. All three species occupy wetland <br /> habitats,although generally with better conditions than currently provided by the project portion of Little <br /> Johns Creek. <br /> Recent surveys were not conducted during the optimal period for all plant species that have potential to be <br /> present. However,because the highly modified condition of the site has not changed materially since t <br /> more extensive,focused surveys were conducted(see the 1994 EIR),it was concluded that habitat for [�1; <br /> most of these plant species is not present,even though the site may be within the known range of the' <br /> species. <br /> lurisdidional Wetlands and other Waters of the M <br /> Regulatory Setting. Section 404 of the Clean Water Act regulates discharge of fill material into waters of <br /> the U.S.,which include wetlands and defined drainages. The U.S. Army Corps of Engineers(Corps)has <br /> permitting authority over proposed fill,such as the relocation of Little Johns Creek to accommodate the <br /> landfill expansion. In addition,under Section 1600 et seq. of the Fish and Game Code,the California D <br /> Department of Fish and Game(CDFG)has permitting authority over work that affects the bed or bank of <br /> streams. CDFG enters into Streambed Alteration Agreements with applicants. Please refer to Appendix D <br /> of the 1994 EIR for a further explanation of the Section 404 and Streambed Alteration Agreement <br /> processes. <br /> Wetlands at the Project Site. Site reconnaissance surveys conducted on September 23, 1999,confirm that <br /> the conditions are largely the same as described in previous documentation. Wetlands associated with <br /> Little Johns Creek total 2.995 acres. The proposed landfill expansion would result in the filling of 7,600 <br /> linear feet,and the temporary loss of 2.895 acres of jurisdictional waters of the United States,including <br /> GRASSETTI ENVIRONMENTAL CONSULTING <br />
