Item No. 3 <br /> PC : 7-19 -84 <br /> PN.-84-136/Rk?-84-18 <br /> Page 1 <br /> REFERRALS AND REPLIES <br /> Local Health District : See Condition No. 1 . <br /> Public Works : See Condition No. 3 . <br /> STAFF ANAIYSIS <br /> Staff reviewed this application and sent out a Notice of <br /> Intention to Approve the Minor Subdivision on April 19, 1984 . <br /> The staff also notified the property owner that the <br /> Right-of-Way had been denied. On April 26, 1984, Monique <br /> Etcheverry appealed the staff decision. <br /> The property owner proposes to divide two parcels for children <br /> who work the property . One of these parcels would be located <br /> along an existing 25 ' right-of-way . It is possible to reorient <br /> the two parcels so that they both have access on Banta Road; <br /> thus , a right-of-way Mould not be necessary, and the division <br /> could meet the County policy that new parcels be 1.ocate(3 on <br /> County maintained roads . <br /> Therefore, the right-of-way was denied, and Condition No. 2 on <br /> the Parcel Map requires that "Parcels A and B shall be <br /> reoriented so that both of them have at least 100 feet of front- <br /> age on Banta Road. " It is this condition and the denial of <br /> the Right-of-Way that is being appealed. <br /> RESPONSE TO APPLICANT 'S APPEAL <br /> The property owner states that it is dangerous to have lots <br /> front on Banta Road: <br /> By reorienting the parcels, there will be no more frontage <br /> along Banta Road than is currently proposed. <br /> The property owner states that there already exists one lot on <br /> this priN-ate road: <br /> Parcel M.&p PM-76-232 created the flag lot which uses the <br /> right-of-way . That parcel was created to deed the existing <br /> resid_ncc to a son who earned his income from the property. <br /> FINDINGS <br /> A . The proposed map is consistent with applicable General and <br /> Specific Plans : <br />
