Item No.
PC: 10-4-90
MS-91-7
Page 1
RECOMMENDATION
It is recommended that the Planning Commission deny Minor
Subdivision Application No. MS-91-7 because Finding No. 1 cannot
be made.
FINDINGS
1. The proposed map is consistent with applicable General and
Specific Plans.
° This Finding cannot be made because the proposal is
inconsistent with the provisions of the AG-40 zone, which
is the implementing zone for the General Plan.
Specifically, the application does not meet the intent
of the provision for creating a homesite parcel for the
owner-operator since an owner-operator homesite parcel
was granted to the applicant in 1984 .
2 . The design or improvement of the proposed division is
consistent with applicable General and Specific Plans.
° This Finding can be made because the design and
improvements meet the minimum standards contained in the
General Plan and as reflected in the tentative map.
3 . The site is physically suitable for the type of development.
° This Finding can be made because all development
requirements in the County Planning Title and all minimum
County standards are met.
4 . The site is physically suitable for the proposed density of
development.
° This Finding can be made because each lot is adequately
sized to meet zoning requirements.
5. The design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or
substantially and avoidably injure fish or wildlife or their
habitat.
° This Finding can be made because the Initial Study
prepared for this project did not identify any rare or
endangered species or habitats or other substantial,
adverse environmental impacts.
