N <br /> Recommendations <br /> Action <br /> It is recommended that the Planning Commission! <br /> 1. Deny Quarry Excavation Application No. QX-01-1 based on the inability to make Finding No. <br /> 1. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding cannot be made because the application is inconsistent with the Development <br /> Title standards required for a Quarry Excavation application and an Agricultural <br /> Excavation Permit application. The average grade elevation of the project(13.1 feet) is <br /> lower than the average natural grade of the surrounding land (13.9 feet). An Agricultural <br /> Excavation permit may be acceptable if the average grade elevation of the project is no <br /> less than the average elevation of the natural grade of the surrounding land (Development <br /> Title Section 9-1410.3[b.41). Quarry Excavation applications may be accepted for submittal <br /> in the AG zone provided that the areas for excavation are designated "Resource <br /> Conservation" on the County General Plan Map and the State Mines and Geology Board <br /> has identified the areas as construction aggregate deposits of regional significance; the f <br /> portion of the property to be excavated contains substantial deposits of mineral resources [ ✓J <br /> or a portion of a deposit of substantial mineral resources; or the Farmland Mapping and <br /> Monitoring Program's soli classification for that portion of the property to be excavated is <br /> neither Prime Farmland, Farmland of Statewide Significance, nor Unique Farmland <br /> (Development Title Section 9-854.2). <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the utility, roadway improvements, sanitation,water <br /> supply, drainage, or other necessary facilities required as a result of this project are - <br /> required as Conditions of Approval. The Department of Public Works-requires private <br /> roads to be maintained to control dust and ensure loads hauled on public roads are <br /> maintaining legal load limits. In addition, Traffic Impact Mitigation Fees will be required <br /> prior to development,and a Maintenance Agreement shall be initiated by the owner to <br /> ensure that Bowman Road, Manthey Road, and all other roads designated by the haul <br /> route plan are maintained to a condition acceptable to San Joaquin County. The <br /> Department of Public Health Services will regulate water supply and sanitary facilities for <br /> all employees who are involved with the project. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the property involved is of adequate size, 61.62 acres, <br /> and shape, 1950 feet of frontage along Bowman Road, to accommodate the proposed use. <br /> There are no structures proposed for construction as a result of this project. <br /> San Joaquin County QX-01-11Noceti Farms <br /> Community Development Page 6 <br />
