9.a. & c. The EIR's traffic analysis indicated that Levels of <br /> Service (LOS) for cumulative conditions Wold fall below the <br /> minimum accepted level of "C. " In order to maintain an <br /> acceptable LOS under cumulative conditions, the developer will <br /> be required at the tentative map stage to contribute the <br /> necessary pro rata share of the cost associated with the <br /> necessary road improvements identified by the Final EIR. <br /> i <br /> 10. The conclusion of the EIR was that there would be no <br /> significant, unavoidable adverse impacts related to cultural <br /> resources. However, in the event that such resources or human <br /> remains are discovered on the site, specific actions are <br /> required to protect them. <br /> 13 . a. The project was not found by the EIR to be a growth- <br /> inducing action. <br /> 14 . Air quality impacts associated with the project were the only <br /> cumulative impacts identified by the EIR. In approving the <br /> earlier General Plan Map Amendment and Zone Reclassification <br /> applications, the Board of Supervisors adopted both "Findings <br /> of Significant Environmental Impact" and "Statements of <br /> Overriding Considerations. " Approval of this application <br /> would require that the same actions be taken by the Planning <br /> commission. <br /> 16.a. The EIR indicated that the project would have an adverse <br /> impact upon the habitat of the Swainson' s hawk and would <br /> result in adverse cumulative air quality impacts. The former <br /> will be mitigated at the tentative map stage by either the <br /> acquisition and improvement of off-site foraging habitat or by <br /> entering into an agreement to join the City of Stockton's <br /> Swainson' s Hawk Habitat Conservation Program.
