Except as otherwise noted, all the above Conditions shall <br /> be complied with prior to the County's acceptance of the <br /> subdivision' s improvements. <br /> 4 . The following measures shall be taken to preserve the site's <br /> Swainson's hawks nesting trees: <br /> a. All potential nest trees on the site for the Swainson's <br /> hawk shall be identified by a qualified biologist and <br /> preserved, unless the trees pose a safety hazard. A map <br /> of the nest trees shall be submitted to the Community <br /> Development Department prior to the approval of the Final 1 <br /> Map. I <br /> i <br /> b. A one-half mile no-construction-activity-buffer shall be <br /> established around active Swainson's hawk nest sites <br /> during the breeding season, from March 1 through August <br /> 1. <br /> 5. The developer shall purchase in fee or easement at least <br /> sixty-three (63) acres of low-quality Swainson' s hawk foraging <br /> habitat near the project site and convert it to high-quality <br /> Swainson's hawk foraging habitat. The site shall be selected, <br /> maintained, and improved as stated in the "Summary of Impacts, <br /> Mitigation Measures and Monitoring Program" of the project' s i <br /> Environmental Impact Report (No. ER-90-3) . The site shall be <br /> donated to the California Department of Fish and Game (DFG) or <br /> a private land preservation and management organization and <br /> shall be maintained in lightly grazed annual grassland, <br /> alfalfa, or other compatible hick-quality foraging habitat. <br /> Operating and maintenptnce funds shall be provided by the <br /> developer to maintain the site until newly-planted trees are <br /> established and self sustaining. The site shall be acquired <br /> and its Management' Plan shall be approvedby the DFG prior to <br /> the approval of the Final Map. <br /> 6. Bicycle lanes and sidewalks shall be provided on the east side <br /> of Jack Tone Road (from the northern boundary of the project <br /> site to the southerly Jack Tone Road entrance to the project) <br /> and along the public street to be constructed in the northern <br /> portion of the project site. The improvements shall be shown <br /> on the Final Map and be installed prior to the County's <br /> acceptance of the subdivision' s improvements. <br /> 7. The homeownersassociation shall be responsible for <br /> preserving the depth, stability, water quality, and aesthetics <br /> of the projects 's lake and its banks and to regulate the use <br /> of the lake for the benefit of homeowners. The maintenance of <br /> the lake shall comply with the Mitigation Measures contained <br />
