The homeowners' association shall be responsible for <br /> preserving the depth, stability, water quality, and aesthetics <br /> of the projects's lake and its banks and to regulate the use <br /> of the lake for the benefit of homeowners. The maintenance of <br /> the lake shall comply with the Mitigation Measures contained <br /> in the project's Environmental Impact Report (No. ER-90-3) . <br /> Information regarding these homeowners' association <br /> responsibilities shall be placed in the Covenants, Conditions, <br /> and Restrictions (CC&Rs) . <br /> 8 . The Sharon Road Specific Plan shall be abandoned prior to the <br /> approval of the Final Map. <br /> NOTE: These Conditions of Approval are based upon the mitigation <br /> measures recommended in the Final Environmental Impact Report for <br /> this project. Changes may be warranted as a result of comments <br /> that may be received from responsible agencies by the end of the <br /> State Clearinghouse referral period on October 21, 1992 . <br /> re <br /> NOTE: A Mitigation Monitoring Program will be prepared as a Part <br /> of the Staff Report for the full application for action by the <br /> Planning Commission. <br /> i COUNTY COUNSEL: <br /> 1. Pursuant to Section 66474.9 of the Government Code, the <br /> subdivider shall defend, indemnify, and hold harmless the <br /> local agency or its agents, officers, and employees from any <br /> claim, action, or proceeding against the local agency or its <br /> agents, officers, or employees to attack, set aside, void, or <br /> annul an approval of the local agency, advisory agency, appeal <br /> board, or legislative body concerning a subdivision, which <br /> action is brought within the time provided for in Section <br /> 66499 .37 of the Government Code. <br />
