i CONDITIONS OF APPROVAL PA-0600348 Chinchiolo Minor Subdivision Application No. PA-0600348 was approved by the-,San Joaquin County Community Development Department on April 16, 2008. The effective date of approval is April 26, 2008: This tentative map approval will expire onApril 26, 2011, which is three years from the effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot be modified, and other Ordinance requirements may apply. 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Mo Hatef, [209]468-8477) a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance .is required for all parcels. The property descriptions submitted with the Certificate of Compliance application shall substantially conform with the approved revised tentative map dated.December 18, 2007. A fee is required to process the Certificate of Compliance Application. ( Development Title Section 9-890.4) b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall be placed on the Certificate of Compliance: (1)" All persons purchasing lots within the boundaries of this approved map'should be prepared to accept the inconveniences or discomforts associated with agricultural operations or activities, such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such inconveniences or discomforts shall not be considered to be a nuisance. c. LOT SIZE AND WIDTH: The following lot-size and width regulations shall apply to this map: (1) Ali parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. (Development Title Section 9-610.4) (2) All parcels shall have a minimum lot area of 40 acres. (Development Title Section 9-610.2) d. TREE PRESERVATION: Future.development on the parcels shall be: consistent with the requirements of the County's Tree Preservation Ordinance: (1) The following note shall be recorded as a separate instrument with the Certificate of Compliance: A. The removal of a Native Oak Tree, Heritage Oak Tree, or Historical,Tree shall require an approved Improvement Plan application. Replacement of any tree removed under Development Title Section 9-1505.3 shall be as specified in Section 9-1505.4. (2) If the tree is to remain, development constraints shall be noted on the subdivision plans, consistent with Section 1505.5 of the Development Title. e.
