Recommendations Action It is recommended that the Planning Commission: 1. Approve the Negative Declaration; and 2. Approve the Revisions of Approved Actions Application No. PA-1000127 for Use Permit No. U- 81-14 with the Revised Conditions of Approval contained in the staff report. Revised Conditions APPROVED USB: Condition of Approval No. 11 of Use Permit No. U-81-14 is revised as follows: 1. The permitted use shall not at any time develop into a nuisance, as herein defined. If, in the opinion of the Board of Adjustment, Planning Commission or Board of Supervisors, any County Ordinance or State Law or regulations or conditions attached hereto are being violated in connection with the operation of this use, that they retain the power to revoke or modify this permit. For the purposes of this use permit, as nuisance is defines as follows: "Nuisance is defined as anything resulting from unreasonable or unlawful practices or from neglect which is, or tends to be injurious to health, safety, or public welfare, or is unsightly or offensive to the senses so as to interfere with the comfortable enjoyment of life or property in the neighborhood area, as such neighborhood area is defined by the Planning Department, Commission or Board of Adjustment." 2. The attached Plot-Plan is hereby made a permanent part of this approved use permit and shall be identified as"EXIJBIT A,"and all construction, reconstruction, moving, remodeling or other structural alteration shall be made in conformity therewith. Any variation from said Plot Plan shall be first approved by the Planning 13,j partment, Commission or Board of Adjustments. 3. This use is granted under the condition that said permit not be transferred within a 90-day period after the date of approval.'; 4. This Use Permit shall expire at the end of one year after the date of approval if construction has not been commenced and/or diligently pursued to completion. In addition, this Use Permit shall be null and void if r the use(s)permitted are abandoned or unused for one year. 5. A Development Plan showing compliance with all conditions approved by all applicable departments. 6. Use Permit to be!reviewed by the Board of Supervisors in July, 1981 to determine if there are any objections or problems within the neighborhood 7. Provide a 3,400 square foot minimum size outside play area with a 6 foot high fence. 8. Provide four employee parking spaces and paved off-street drop-off areas. 9.
