Eleventh Street <br /> Tracy, CA 95376 <br /> The San Joaquin County Environmental Health Department (EHD) has reviewed <br /> Recommendations for Closure - Former Fueling Station, 7500 West Eleventh Street Tracy, <br /> California (RfC), dated 17 December 2008, prepared by The San Joaquin Company, Inc. <br /> (TSJCI). In addition, the EHD has reviewed the access agreement letter dated 04 June 2008, <br /> sent by TSJCI to the property owner of the adjacent property to obtain access to that property to <br /> remediate groundwater polluted by the unauthorized release from the underground storage tank <br /> (UST) system formerly on your site. To assist your gaining an access agreement, the EHD has <br /> a letter in preparation requesting the property owner, Mr. Russ Zelman, to provide the access <br /> and/or to meet with you, TSJCI and the EHD to address the needed groundwater remediation <br /> issue. <br /> In RfC, TSJCI recounted the latest developments with the State Water Resources Control Board <br /> Cleanup Fund (the Fund) and the current state of site characterization, and provided a <br /> recommendation for immediate site closure or a greatly reduced monitoring program. To justify <br /> the closure request, TSJCI pointed out that the plume has been well-characterized, natural <br /> attenuation is occurring, and TSJCI stated their belief that natural attenuation will fully remediate <br /> the impacted groundwater over time. Short of site closure, TSJCI recommends a severely <br /> reduced groundwater monitoring program involving annual sampling of only two monitoring <br /> wells. <br /> The EHD does not concur with either the closure recommendation or the proposed monitoring <br /> program. This decision is subject to appeal to the State Water Resources Control Board (State <br /> Water Board), pursuant to H&SC Section 25296.40(x)(1), (Thompson-Richter Underground <br /> Storage Tank Reform Act — Senate Bill 562). Please contact the State Water Board <br /> Underground Storage Tank Program at (916) 341-5752 or visit the State Water Board internet <br /> website at http://www_wate_r_boards.ca.gov/usUcleanup/petitions,html for information regarding <br /> the appeals process. <br /> The reasons the EHD cannot concur with the closure recommendation are as follows: <br /> • TSJCI did not provide an estimate of the time required for natural attenuation to achieve <br /> background conditions or the Central Valley Basin Plan Water Quality Objective (WQOs) <br /> Closure Request Response Letter 1208 <br />
