Neighborhood Opposition <br /> The Community Development Department received six (6) letters and two (2) petitions in opposition to the <br /> project. The opposition letters and petitions expressed concerns regarding odor, air quality, pests and <br /> vectors, traffic, wastewater management, property values, and the enjoyment of property. <br /> Odor: The neighborhood opposition raised the concern of odor from the incineration of dead birds and <br /> from manure. The neighbors in opposition also raised concerns regarding air quality issues and pests that <br /> could be generated as a result of the project. Surrounding land uses to the north, south, east, and west <br /> include agricultural crops and single-family residences with detached accessory buildings on agriculturally <br /> zoned parcels. The Development Title Section 9-110.4 defines an agricultural operation as any land- <br /> related activity on agriculturally zoned lands whose purpose is cultivating or raising plants or animals.The <br /> San Joaquin County Right-To-Farm Ordinance (Section 6-9004(3)) recognizes and supports the right to <br /> farm agricultural lands in a manner consistent with accepted customs, practices, and standards. <br /> Residents of property on or near-agricultural land should accept the inconveniences or discomforts <br /> associated with agricultural operations or activities, including but not limited to noise, odors, insects, <br /> fumes, dust or the operation of machinery during any 24-hour period. San Joaquin County has <br /> determined that inconveniences or discomforts associated with such agricultural operations or activities <br /> shall not be considered a nuisance. Therefore, any odor and pest related impacts are considered to be <br /> less than significant. <br /> -Pursuant to Development Title Section 9-1045.4(b), "Ali animal enclosures, including but not limited to <br /> pens, cages, and feed areas, shall be maintained free from litter, garbage, and excessive accumulation of <br /> manure, so as to discourage the proliferation of flies, other disease vectors, and offensive odors. <br /> Premises shall be maintained in a neat and sanitary manner." If the project is approved, this ordinance <br /> requirement regarding waste and maintenance will be included within the conditions of approval, as well <br /> as a condition of approval that a revised Manure Management Plan outlining the handling of all bird(s) <br /> wastes and incorporating vector control measures must be submitted to the Environmental Health <br /> Department for review and approval prior to expansion of the chicken ranch operation. In addition, the <br /> project applicant is proposing to stop incinerating dead-birds and instead place the dead birds in freezers <br /> to be hauled off-site on a weekly basis.This will further reduce the potential for odors to emanate from the <br /> project site. <br /> in regards to air quality concerns, a referral was sent to San Joaquin Valley Air Pollution Control District <br /> (APCD)for review and APCD required a Health Risk Assessment (HRA)to be performed to determine the <br /> health impact of Toxic Air Contaminants (TP.Cs). As previously stated, the APCD concluded that the project <br /> would not result in a significant health risk due to Toxic Air Contaminants(TACs). However, the project may <br /> require an Authority to Construct (ATC) prior to the start of construction-and also may be subject to other <br /> APCD rules and regulations. With the rules and regulations of the SJVAPCD and the Environmental <br /> Health Department, the odors, air-quality, and pest impacts are expected to be less than significant. <br /> Traffic: The neighborhood opposition raised concerns about traffic. Eighty-six (36) trucks will access the <br /> site per week and there will be no increase in the number of employees. The Department of Public Works <br /> reviewed the project and states that the proposed project would have a less than significant impact on traffic <br /> on-the local streets because the expansion of the existing development project is not expected to increase <br /> traffic in excess of fifty (50) vehicles during an hour. In addition, as a recommended condition of approval, <br /> the owner shall improve driveway approaches in accordance with the requirements of San Joaquin County <br /> Improvement Standards Drawing No. R-17 prior to release of the Improvement Plan to improve access to <br /> and from the site. <br /> San Joaquin County PA-1500200/Jenkins <br /> Community Development Page 6 <br />
