• This finding can be made because the Initial Study prepared for the project found no
potentially significant environmental impacts. The Central Valley Regional Water Quality
Control -Board stated that the project would be required to file a Notice of Intent and
receive coverage under the General Order. The design and construction of any new ponds
would also require Executive Officer approval prior to construction and use, and that
water flowing through the fan emissions area should be managed through the wastewater
management system. In addition, the San Joaquin Valley Air Pollution. Control District
concluded that -the project sFrecific criteria pollutant emissions would not have a
significant adverse impact on air quality, and that the project would not be subject to
District Rule 9510 (Indirect Source Review). In addition, the proposed use is agricultural in
nature and the property is zoned AG-40 (General Agriculture with a 40-acre minimum).
Pursuant to the San Joaquin County Right-To-Farm Ordinance (Section 6-9004[3]), the
inconveniences or discomforts associated with agricultural operations or activities,
including but not limited to noise, odors, insects, fumes, dust or the operation of
machinery during any 24-hour period sha!I not be considered a nuisance. The project is
also subject to Development Title's ordinance requirements. Therefore, the project is
expected to have a less than significant impact on the environment.
5. The use is compatible with adjoining land uses.
• This finding can be made because the proposed use will not interfere with nor alter the
current land uses on adjacent properties. Surrounding land uses to the north, south, east,
and west include agricultural crops and single-family residences with detached accessory
buildings on agriculturally zoned parcels. The proposed use is agricultural in nature and the
project site is zoned AG-40(General Agriculture with a 40-acre minimum).
Williamson Act Principles of Compatibility
1. The use will not significantly compromise the long-term productive agricultural capability of the subject
contracted parcel or parcels or on other contracted lands in agricultural preserves.
This Principle of Compatibility can be made-because the proposed use is for a poultry egg
farm and is an agricultural use as defined in the Williamson Act. The use is an approved use
on contracted lands pursuant to Deveiopment Title Section 9-1810.3. The proposed
expansion will not impact the long-term productive agricultural capability of other
contracted lands in the agricultural preserves.
2. The use will not significantly displace or impair current or reasonably foreseeable agricultural operations
on the subject contracted parcel or parcels or on other contracted lands in agricultural preserves. Uses
that significantly displace agricultural operations on the subject contracted parcel or parcels may be
deemed compatible if they relate directly to the production of commercial agricultural products on the
subject contracted parcel or parcels or neighboring lands, including activities such as harvesting,
processing, or shipping.
• This Principle of Compatibility can be made because the use will not significantly displace
or impair current or reasonably foreseeable agricultural operations on the subject
contracted parcel or parcels or on other contracted lands in agricultural preserves. The
proposed use is for a poultry egg farm on the contracted parcel.
San Joaquin County PA-1500200/Jenkins
Community Development Page 9
