The Community Development Department has reviewed the above referenced <br /> application and offers the following comments: <br /> Background <br /> The existing site contained a poultry ranch that was established before 1961. On August <br /> 29, 1983, the Community Development Department approved Development Plan <br /> application No. DP-79-80 for an expansion to the poultry ranch. The site remained in use <br /> until approximately 1990. <br /> On February 18, 1993, the Planning Commission approved Site Approval application No. <br /> SA-92-0073 to re-establish a poultry farm within the existing structures for a maximum of <br /> 300,000 birds. Neighbors appealed the approval to the Board of Supervisors. On April <br /> 21, 1993, the Board of Supervisors denied the appeal and upheld the Planning <br /> Commission's approval of the project with the addition of a condition of approval <br /> requiring that the applicant provide information to an adjacent property owner upon <br /> reasonable request related to the site's compliance with governmental regulations. The <br /> adjacent property owner owned the property to the west (APN: 207-090-07), which <br /> contained an ostrich farm. This property now contains an orchard and is under new <br /> ownership. <br /> Williamson Act <br /> The project site is subject to Williamson Act contract No. WA-72-C1-0097. The contract <br /> restricts development to uses that are compatible with the Williamson Act and <br /> Development Title Section 9-1805. "Compatible Use" as defined in the Williamson Act <br /> includes uses determined by the County to be compatible with the agricultural, <br /> recreational, or open-space use of land within the preserve and subject to contract. (GC <br /> Section 51201[e]) On July 20, 1992 the Board of Supervisors adopted Ordinance 3697 <br /> finding that Animal Raising — Small Animals is compatible with the Williamson Act. <br /> Additionally, pursuant to Government Code Section 51238.1, uses approved on <br /> contracted lands shall be consistent with the following three principles of compatibility: <br /> (1) The use will not significantly compromise the long-term productive agricultural <br /> capability of the subject contracted parcel or parcels or on other contracted lands <br /> in agricultural preserves. <br /> • This Principle of Compatibility can be made because the proposed use is <br /> for a poultry egg farm and is an agricultural use as defined in the <br /> Williamson Act. The use is an approved use on contracted lands pursuant <br /> to Development Title Section 9-1810.3. The proposed expansion will not <br /> impact the long-term productive agricultural capability of other contracted <br /> lands in the agricultural preserves. <br /> (2) The use will not significantly displace or impair current or reasonably foreseeable <br /> agricultural operations on the subject contracted parcel or parcels or on other <br /> contracted lands in agricultural preserves. Uses that significantly displace <br /> agricultural operations on the subject contracted parcel or parcels may be <br /> deemed compatible if they relate directly to the production of commercial <br /> agricultural products on the subject contracted parcel or parcels or neighboring <br /> lands, including activities such as harvesting, processing, or shipping. <br /> 2 <br />
