Approve a Negative Declaration and instruct the Clerk to file <br /> a Notice of Determination; and <br /> 2 . Approve Use Permit Application No. UP-87-12 based on the fin- <br /> dings in the staff report and subject to the conditions of <br /> approval in the staff report . <br /> FINDINGS <br /> 1 . "The establishment , maintenance, and operation of the use <br /> does not conflict with the General Plan. " <br /> ° This finding can be made because the project is consistent <br /> with the General Plan Retail Commercial policies. <br /> 2 . "Adequate utilities, access roads, sanitation, drainage, and <br /> other necessary facilities have been provided, .and the pro- <br /> posed improvements are properly related to existing and pro- <br /> posed streets and highways . " <br /> ° This finding can be made because facilities are already in <br /> place, or their provision will be required as conditions of <br /> approval for this Use Permit . <br /> 3 . "The property involved is of adequate size and shape to <br /> accommodate the proposed use and all yards, building <br /> coverage, setbacks, parking areas, and other requirements of <br /> this Title . " <br /> This finding can be made because the use currently meets <br /> code requirements as demonstrated by the site plan sub- <br /> mitted with the Use Permit application. <br /> 4 . "Issuance of the permit will not be significantly detrimental <br /> to the public health, safety, or welfare or be injurious — <br /> to-the property or .improvements of adjacent properties.
