Approve a Negative Declaration and instruct the Clerk to file . a Notice of Determination; and 2 . Approve Use Permit Application No. UP--87--12 based on the fin- dings in the staff report and subject to the conditions of approval in the staff report . FINDINGS 1 . "The establishment , maintenance, and operation of the use does not conflict with the General Plan. " ° This finding can be made because the project is consistent with the General Plan Retail Commercial policies. 2 . "Adequate utilities, access roads, sanitation, drainage, and other necessary facilities have been provided, and the pro- posed improvements are properly related to existing and pro- posed streets and highways. " I ° This finding can be made because facilities are already in place, or their provision will be required as conditions of approval for this Use Permit. 3.. "The property involved is of adequate size and shape to accommodate the proposed use and all yards, building coverage, setbacks, parking areas, and other requirements of this Title. " ° This finding can be made because the use currently meets code requirements as demonstrated by the site plan sub- mitted with the Use Permit application. 4. "Issuance of the permit .will not be significantly detrimental to the public health, safety, or welfare or be injurious to the property or improvements of adjacent properties. " ° This finding can be made because the primary use already exists, and this accessory use can be added without being a detrimental to the area.
