Item No. 1 <br /> PC: 4-4-91 <br /> MS-91-46 <br /> STAFF ANALYSIS <br /> BACKGROUND: <br /> John and Rita Boggianc have applied for this subdivision to give a <br /> three-acre parcel to their daughter, Beverly Sambado. Beverly <br /> Sambado is currently living at 8077 N. Tully Road on a 20-acre <br /> parcel that she owns. She stated that she is involved in her <br /> parents farming operation and that she and her husband farm many <br /> other properties. She also stated that they do not plan to build <br /> on the proposed site immediately but that when their children <br /> leave, they would want a smaller new home. On March 1, 1989, Minor <br /> Subdivision No. MS-89--54 was approved to create a three-acre <br /> family-member homesite for their other daughter, Barbara <br /> Costigliolo, from the same parcel as in this application. <br /> Staff was contacted by John Eilers, a property owner in the area . <br /> Mr. Eilers believes this subdivision is an abuse of the homesite <br /> provision. Because of this opposition, the Minor Subdivision <br /> application is being referred to the Planning Commission . <br /> POLICY CONSIDERATIONS°_ <br /> ordinance : <br /> Mr. Eilers ' objection to this subdivision is based on the fact <br /> that the family member does not "need" this parcel to <br /> participate in the farming operation. The language of the <br /> ordinance covering family member homesite parcels does not <br /> address itself to "need. " There are six requirements in <br /> Section 9-4010 . 2 (B) that need to be met: <br /> 1 . The homesite parcel must contain a minimum of 1'l acres. <br /> • The proposal is for a three-acre homesite . <br /> 2 . The original parcel must be at least 20 acres. <br /> • The original parcel is 117 . 5 acres. <br /> 3 . The purpose of the subdivision is to finance a residence <br /> for a member of the family. <br /> • The applicant has stated that they would be <br /> financing a residence in the future when their <br /> daughter no longer needed the large house she lives <br /> in on Tully Road. <br /> 1 <br /> G- <br />
