Tom Gau
February 18, 1998
Page 2
• To accommodate new students, the District may need to increase
classrooms, cafeterias, bathrooms, etc. Transportation costs would
increase if buses are needed to transport students to other school
sites.
In satisfaction of the San Joaquin County General Plan requirements at
N. 82-83, the District makes the following representations to the County,
including the Planning Commission/Board of Supervisors.
1. The Linden Unified School District has imposed all school
mitigation fees possible pursuant to Government Code section 53050. The fees
will be insufficient to cover the costs of the influx of new students from t h e
rroposed development. :adequate school facilities cannot be made available
concurrently with the need for such facilities.
2. The Linden Unified School District has filed a current copy of its
School Facilities Plan with the Community Development Department;
3. The School Facilities Plan accurately documents the District's
existing facilities and provides future school facilities projections, both short
and long term, and demonstrates the use of the current and projected revenues
which are anticipated to meet those needs;
4. The School Facilities Plan documents the District's reasonable good
faith efforts to seek all available funding without substantial prejudice to t h e
District's reasonable historical educational standards, and a current
representation regarding the prospects for seeking and/or obtaining funds i n
the reasonable foreseeable future;
5. The District filed any amended School Facilities Plans with t h e
Community Development department within thirty (30) days after their
adoption.
The Linden Unified School District urges that San Joaquin County, i n
order to comply with its own General Plan, require f u 1„J mi t i g,at.io a of the impacts
upon the schools in the Linden Unified School District. Mitigation should
include 'both developer tees and the formation, of a Mello-Roos district unless an
alternative method is found to fully mitigate the impact on the schools. The
District is agreeable to negotiating with the developer and the County in order to
reach agreement on a funding mechanism or other solution which will result in
full mitigation.
The District also believes that the issue of school overcrowding should b e
i addressed in the environmental review process.
incerei ,
14
o ald J t;s` s.
