D R A F T 2. VARIANCE NO.VR-99-6 OF IRA&INICO McATEE C/O BONNIE McATEE to vary the minimum 40-acre parcel size and minimum 330-foot parcel width in the AG-40 zone. This Variance would permit a Minor Subdivision application to be submitted to result in two 5-acre parcels with widths of 239 and 216 feet. The project site is located on the west side of Davis Road, 2200 feet south of Armstrong Road,south of Lodi (Supervisorial District4). This item is continued from the meeting of December 16, 1999,with the hearing closed. Kerry Sullivan, Deputy Director,said that staff was not intending to make a presentation because this item I had been heard at the December 16, 1999, Planning Commission hearing. Chairman Stockar said he has listened to the tapes and has reviewed the information staff has provided. Commissioner Carter said she has also listened to the tapes and has reviewed the information staff has provided. Commissioner Morri said it was not necessary for staff to make another presentation. He said his comments were on the previous tapes of the last Planning Commission meeting and had nothing further to add. Commissioner Carter said she could not make Findings 1 and 2. Chairman Stockar said he had spoken with the applicant this week after the hearing was closed. He said that he has looked at the parcel and the neighborhood. He said that there are a lot of small parcels already in that neighborhood. Commissioner Morh said he cannot make Findings 1 and 2. Commissioner Demichelis said there are many small parcels nearby on which the property owners will want to do the same if this application is approved. Chairman Stockar said that the railroad is an issue. MOTION: It was moved and seconded(Howard/Solari)to approve the Variance. However,this motion failed by a majority roil call vote(3-4).
