WHEREAS, Owner owns that certain real property located in the County <br /> of San Joaquin, California and more particularly described in Exhibit A, <br /> attached hereto and incorporated herein("Parcel I"). <br /> B. WHEREAS, Owner also owns that certain real property located in the <br /> County of San Joaquin, California and adjacent to Parcel 1, and more <br /> particularly also described in Exhibit A,attached hereto and incorporated <br /> herein("Parcel 2"). <br /> C. WHEREAS, on September 9,2013,the San Joaquin County Community <br /> Development Department approved Lot Line Adjustment Application PA-1300073 <br /> ("the Easement") authorizing certain repairs and improvements for septic,well and <br /> water lines on the Parcel 1. <br /> D. WHEREAS,as the Easement requires an access easement to Parcel 2 for the <br /> purpose of maintaining and service to septic lines and well and water lines. <br /> E. WHEREAS,Non-Exclusive Ingress and Egress to Parcel 2 from Parcel 1, across the <br /> Parcel 1 as depicted on the Non-Exclusive Ingress and Egress Access Easement <br /> attached hereto and incorporated herein as Exhibit B. <br /> F. WHEREAS,the County requested that the Owner grant a reciprocal access <br /> Easement,to himself as between Parcel 1 and Parcel 2. <br /> G. WHEREAS, California Civil Code Section 805 states, "A servitude thereon <br /> cannot be held by the owner of the servient tenement." <br />
