H. WHEREAS, Because Owner owns both Parcel 1 (the proposed servient <br /> tenement)and Parcel 2, California Civil Code Section 805 precludes <br /> Owner from creating an easement between the parcels unless or until <br /> Owner sells, gifts,transfers, or otherwise alienates on of the parcels. <br /> I. WHEREAS, In order to satisfy County's concerns regarding future access <br /> for septic and well and water lines to the Parcel 1 while at the same time complying <br /> with California Civil Code Section 805, Owners executes this Notice. <br /> NOW THEREFORE: <br /> 1. The Recitals above are incorporated herein and make a part hereof. <br /> 2. If at any point prior to the Easement expiring, becoming invalid, or <br /> otherwise ceasing to require access across Parcel 1, Owner sells, grants, <br /> transfers,or otherwise alienates Parcel 1,at the time of such sale, grant, <br /> transfer,or alienation, Owner shall reserve or otherwise create a right of <br /> way easement across the Parcel I to access,maintain and service the <br /> septic lines and well and water lines as shown on Exhibit C and be more particularly <br /> described at that time("Future Easement") <br /> 3.
