Analysis <br /> Background <br /> On November 6, 2008, the Planning Commission approved Use Permit Application No. PA-0800203 for <br /> an off-site wine cellar with a maximum of sixteen (16) marketing events per year with a maximum <br /> attendance of 150 people per marketing event (Use Type: Wineries and Wine Cellars- Wine Cellar, Off- <br /> Site). The improvements included a 1,280 square foot wine cellar, a 2,380 square foot arbor for <br /> marketing events, and the conversion of a 3,340 square foot portion of an agricultural building into wine <br /> storage. <br /> The applicant initially applied to increase the number of marketing events from the previously approved <br /> sixteen (16) marketing events per year to thirty-five (35) marketing events per year with the subject <br /> application but decided to remove the request to increase the number of marketing events because of <br /> opposition. The project was referred with the revised project description. The applicant has stated the <br /> previously approved sixteen (16) marketing events will continue to operate as an accessory use to the <br /> proposed winery. <br /> This item, which would ordinarily be processed at staff level, is being referred to the Planning Commission <br /> because of neighborhood opposition. <br /> Winery Operations <br /> The proposed winery will employ a total of five employees. The winery will operate daily from 7:00 a.m. to <br /> 7:00 p.m. The wine tasting room will employ four employees. The wine tasting room will operate <br /> Thursdays through Mondays from 11:00 a.m. to 6:00 p.m. and expects a maximum of 100 customers per <br /> day. <br /> Site Plan <br /> The site plan depicts a proposed 600 square foot commercial kitchen, a 3,400 square foot indoor eating <br /> area, an 850 square foot conference room, and an indoor and outdoor amplified music location. The <br /> commercial kitchen and indoor eating area can only be utilized for marketing events pursuant to <br /> Development Title Section 9-1075.5(m). The applicant has stated the conference room is proposed to <br /> only be used as a meeting area during the work week for employees and not as rentable spaces for the <br /> public to utilize. <br /> The applicant was previously approved for indoor and outdoor amplified music at marketing events under <br /> Use Permit Application No. PA-0800203. The applicant is proposing a new indoor and outdoor amplified <br /> music location and submitted a noise study conducted by J. C. Brennan and Associates dated October <br /> 25, 2012 to identify the noise impacts to surrounding uses. <br /> The noise study concluded the proposed winery can comply with the County noise level standards <br /> provided the following recommendations are implemented: 1) conduct periodic noise measurements <br /> during events at a distance of 100 feet directly in front of the sound system, and should be limited to no <br /> more than 75 dBA or Lmax; 2) the winery staff is trained on how to use the sound level meter, use the <br /> proper settings on the meter and the meter is calibrated prior to events. The sound level meter shall <br /> comply with an ANSI Type 1 or Type 2 certification; and 3) events are required to terminate prior to 10:00 <br /> p.m These mitigation measures are incorporated into the Conditions of Approval. <br /> San Joaquin County PA-1200192\Panella <br /> Community Development Page 3 <br />
