a <br /> F - <br /> BEFORE THE BOARD OF SUPERVISORS OF THE COUNTY OF SAN JOAQUIN <br /> STATE OF CALIFORNIA <br /> R-02- 88 <br /> RESOLUTION APPROVING I ITIATION _Q_F PROCEEDINGS <br /> FOR REVERSION TO ACREAGE <br /> OF FINAL MM BIMITLED TRACT NO. , <br /> ALSO Kai OWIy AS LIGURIAN pI LAGE SUBDIVISION <br /> WHEREAS, on December 17, 1996, the Board, of Supervisors adopted <br /> a Resolution approving the Subdivision Agreement and Final Map of <br /> Tract No. 2616, Ligurian Village Subdivision. The subdivision <br /> created 24 residential lots on 3 .49 acres; and, <br /> WHEREAS, the subdivider had agreed to construct the improvements _ <br /> enumerated in the conditions approved by the Planning Commission on' <br /> June 3 , 1993 . However, the subdivider did not construct the <br /> improvements within the one-year period specified in the Agreement or <br /> within two years from the date the Final Map was filed for record, <br /> and to date has not constructed any 'of the required improvements nor <br /> sold any lots; and, <br /> i <br /> WHEREAS, the improvement securities have been released by the <br /> Department of Public Works, and none of the improvements have been <br /> constructed; and, <br /> WHEREAS, the property owners are not willing to initiate the <br /> process that would have the effect of merging all the subdivided <br /> Lots into one parcel as it existed prior to the subdivision; and <br /> WHEREAS, San Joaquin County Development Title, Chapter 9-869, <br /> specifies that applications for Reversion to Acreage may be initiated <br /> by petition of all owners of record, or by the Board of Supervisors <br /> in a resolution initiating such proceedings; and <br /> WHEREAS, the Department of Public Works is recommending that <br /> the Board of Supervisors authorize the Department of Public Works, <br /> on behalf of San Joaquin County, to begin the process by filing a r <br /> Reversion to Acreage application with the Community Development <br /> Department for Ligurian Village Subdivision (Tract No. 2616) ; and, ! <br /> WHEREAS, San Joaquin County Development Title Section 9-869 . 6 <br /> allows the County to retain all or a portion of the deposited fees j <br /> to accomplish the Reversion to Acreage and to return any unused <br /> portion of the fees to the subdivider; <br /> h <br />
