s <br /> Analysis <br /> Background <br /> The existing dairy has been in operation since 1963, produces approximately 4,000 gallons of milk a day, and <br /> has 4 employees. The applicant will be the sole employee processing approximately 30 gallons of cheese. <br /> There will be no customers or retail sales onsite. The cheese would be processed using milk from the on site <br /> dairy. <br /> Williamson Act <br /> This parcel is subject'to Williamson Act Contract 76-CA-54. The contract restricts development to uses that are <br /> compatible with the Williamson Act and Development Title Section 9-1805. "Compatible use" as defined in the <br /> Williamson Act includes uses determined by the County to be compatible with the agricultural, recreational, or <br /> open-space use of land within the preserve and subject to contract(GC Section 51201[e]). On July 20, 1992,the <br /> Board of Supervisors adopted Ordinance 3675, finding that Agricultural Processing-Food Manufacturing is <br /> compatible with the Williamson Act. Additionally, pursuant to Government Code Section 51238.1, uses approved <br /> on contracted lands shall be consistent with the <br /> following three principles of compatibility: <br /> 1. The use will'hot significantly compromise the long-term productive agricultural capability of the subject <br /> f contracted parcel or parcels or on other contracted lands in agricultural preserves. <br /> • This finding can be made because the proposed use is for the production of food, and is an <br /> agricultdiai use as defined in the Williamson Act. The proposed project will not impact the <br /> long-term productive agricultural capability of other contracted lands in the agricultural <br /> preserves. <br /> 2. The use will not significantly displace or impair current or reasonably foreseeable agricultural <br /> operations on the subject contracted parcel or parcels or on other contracted lands in agricultural <br /> erations on the subject`contracted parcel <br /> preserves, uses that significantly displace agricultural op j p <br /> or parcels may be deemed compatible if they relate directly to the production of commercial <br /> agricultural products on the subject contracted parcel or parcels or neighboring lands, including <br /> activities such as harvesting, processing, or shipping. <br /> This finding can be made because the use will not significantly displace orimpair current or <br /> reasonably foreseeable agricultural operations on the subject contracted:parcel or parcels <br /> or on gther contracted lands in agricultural preserves. The proposed use is for the <br /> processing of agricultural products on the contracted parcel which enhances the current <br /> use on the parcel. <br /> 3. The use will not result in the significant removal of adjacent contracted land from agricultural or <br /> open-space use. In evaluating compatibility a board or council shall consider the impacts on <br /> noncontracted lands in the agricultural preserve or preserves. <br /> This finding can be made because the proposed use, Agricultural Processing-Food <br /> Manufacturing, will encourage continued and expanded agricultural uses in the area. <br /> Therefore, it will not result in the significant removal of adjacent contracted land from <br /> agricultural or open-space use. <br /> San Joaquin County'.'
