As an <br />adjacent property owner, I have a concern regarding a change that has been made to the <br />Conditional Use Permit for Phase 2. <br />The original Use Permit for Phase 1 required a pump for capturing runoff at the northeast <br />corner of the property, and returning it to catch ponds located south of the dairy site. <br />Some of this water is from fields and some is drainage from cattle corrals on the dairy site. <br />This natural drain then continues across° property owned by my father and eventually ends <br />in Temple Creek. This field is used for growing crops for my dairy located 1/2 mile east of <br />the Da Silva property. This pump, however, has never been installed, and runoff from the <br />fields and dairy site continues to leave Da Silva's property. <br />The Phase 2 application has now changed this original requirement. to simply a valve and a <br />promise that it be "closed during winter months to keep runoff from leaving (the) <br />property." In practice, this is not possible, since the water has nowhere to go and will <br />eventually overflow Dodds and enter the natural drain anyway. Since this water has come <br />into contact with manured areas, legally it may never leave the property and enter a natural <br />waterway. I am afraid that this project,- if approved with the current conditions, will be <br />unable to operate in an environmentally sound way.
