CONDITIONS OF APPROVAL <br /> PA-1700252 <br /> Bendix and Willett/Aspen Survey Company, Inc. <br /> Minor Subdivision Application No. PA-1700252 was approved by the Community Development <br /> Department on April 13, 2018. The effective date of approval is April 23, 2018 . This tentative map <br /> approval will expire on April 22, 2021, which is three (3) years from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed <br /> with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be <br /> modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Alisa Goulart, (209) 468-0222) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated October 27, 2017. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map and recorded as a separate instrument: <br /> All persons purchasing parcels within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural <br /> operations or activities, such as noise, odors, insects, dust or fumes. San Joaquin County <br /> has determined that such inconveniencies or discomforts shall not be considered to be a <br /> nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 200 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area often (10) acres. (Development Title Section 9-610.2) <br /> d. RIPARIAN HABITAT: Parallel to the southern property line of Parcel 3 and Parcel 4, a natural <br /> open space area for riparian habitat and waterway protection shall be maintained to provide <br /> nesting and foraging habitat and the protection of waterway quality. The minimum width of said <br /> open space shall be one-hundred (100) feet, measured from the mean high water level of the <br /> natural bank or fifty (50) feet back from the existing riparian habitat, whichever is greater. Water- <br /> dependent uses may be permitted in this buffer. The mean high water level and the edge of the <br /> riparian habitat shall be shown on the Parcel Map. The open space buffer required above shall be <br /> shown on the Parcel Map with the following note: <br /> Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection.
