L. The Applicant shall supply and install regulatory signage at each of the Pedestrian Connections between Tract 3636 and the Mountain House Creek Pedestrian D.G. Path. Regulatory signage shall match the signage utilized within the Mountain House Creek Park, and shall be consistent with all Community Approvals including applicable provisions of the MHCSD Design Manual, and MHCSD Standards. Regulatory signage and locations shall be reviewed and approved by the MHCSD General Manager. Timing: Condition shall be met prior to first building permit. Completion time may be modified by the MHCSD General Manager to reflect construction,weather, budget, or other public interest contingencies. M. The Applicant shall install and maintain an Irrigation System within the area between the Property Line of Tract 3636 and the Mountain House Creek Pedestrian D.G. Path from Central Parkway to Estes Way. Irrigation System shall be installed concurrently with the proposed three (3) Pedestrian Connections. Design shall be consistent with all Community Approvals including applicable provisions of the MHCSD Design Manual, and MHCSD Standards. Design and all Construction shall be reviewed and approved by the MHCSD General Manager. Timing: Condition shall be met prior to first building permit. Completion time may be modified by the MHCSD General Manager to reflect construction, weather, budget, or other public interest contingencies. N. The Applicant shall replant vegetation as necessary, Hydroseed, and maintain landscape within the area between the Property Line of Tract 3636 and the Mountain House Creek Pedestrian D.G. Path from Central Parkway to Estes Way. Landscape shall be installed, and maintained on a continual basis to provide Green Vegetative Conditions for Fire Prevention / Suppression. Design, construction and maintenance shall be consistent with all Community Approvals including applicable provisions of the MHCSD Design Manual, and MHCSD Standards. Design, Construction, and Maintenance shall be reviewed and approved by the MHCSD General Manager. Timing: Condition for design and construction shall be met prior to first building permit; maintenance shall be performed in perpetuity. Completion time may be modified by the MHCSD General Manager to reflect construction, weather, budget, or other public interest contingencies. 111. COUNTY COUNSEL 1. HOLD HARMLESS PROVISION: Pursuant to Section 66474.9 of the Government Code, the subdivider shall defend, indemnify, and hold harmless the local agency or its agents, officers, and employees from any claim, action, or proceeding against the local agency or its agents, officers, or employees to attack, set aside, void, or annul an approval of the local agency, advisory agency, appeal board, or legislative body concerning a subdivision,which action is brought within the time provided for in Section 66499.37 of the Government Code. IV. ENVIRONMENTAL HEALTH DEPARTMENT (STAFF CONTACT: GREG OLIVEIRA, 209-468-3854) 1. The Environmental Health Department has reviewed a Surface/Subsurface Contamination Report(Environmental Site Assessment)dated October 29,2001 and a Phase II Environmental Assessment dated July 9, 2002. Because over one year has elapsed since the preparation of the Surface/Subsurface Contamination Report, an addendum must be submitted to and approved by the Environmental Health Department prior to recordation of the Final Map. 2. Submission of three (3)sets of detailed public swimming pool plans to the Environmental Health Department for review and approval prior to issuance of building permit(s)(Code of Regulations, Title 22, Section 65505). 29
