7. Monitoring Program: The Final Map(s)shall comply with the attached Mountain House <br /> Master Plan and Speck Plan I San Joaquin County Mitigation Monitoring Program. <br /> 8. Monitoring Agreement: The applicant or the applicant's assignee shall fund the <br /> Community Monitoring and Mitigation Monitoring Programs. The applicant or the applicant's <br /> assignee shall also fund the County's efforts to monitor compliance with the Tentative Map <br /> conditions of approval. [General Plan Community Organization and Development Policy <br /> (19)0)1 <br /> Timing: Ongoing. <br /> AGRICULTURAL RESOURCES <br /> 9. Agricultural Mitigation Fee: If a Countywide agricultural mitigation fee is established <br /> prior to adoption of the Final Map, the applicant shall pay this fee to the County for each <br /> agricultural acre converted to urban use, or as directed by the specific fee program. <br /> Timing: payment to be made as required in adopted fee program. <br /> 10. Right To Farm Recordation And Notification: The Final Map and the deed of each <br /> condominium unit shall include the following recording notification, as specified by San <br /> Joaquin County Ordinance 4217 which added Section 6-9004 et. seq. to Chapter 1 of <br /> Division 9 of the San Joaquin County Ordinance Code regarding the Right to Farm <br /> Notice: "All persons purchasing lots within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural operations <br /> or activities, such as noise, odors, insects, dust or fumes. San Joaquin County has <br /> determined that such inconveniencies or discomforts shall not be considered to be a <br /> nuisance." <br /> Timing: Prior to approval of Final Map. [MP implementations 3.2.4 b), and c)] <br /> NOISE <br /> 11. Outdoor Noise Levels: Best available noise reduction measures shall be implemented <br /> by the applicant to reduce noise levels in primary outdoor use areas (backyards)of new <br /> residential development to an Ldn of 60 dB. Where it is not possible to reduce noise <br /> levels to this level using practical application of the best available noise reduction <br /> measures, an exterior noise level of up to 65 db may be allowed. In the case that noise <br /> levels cannot be reduced to the design noise level of 60 dB, the applicant must provide <br /> notice via a note on the deed of each condominium unit along Central Parkway and Main <br /> Street stating that noise levels may exceed 60 dB. [MP Policy 11.3.1 (e)] <br /> Timing: Final map note approved by CDD prior to final map approval and deed notes <br /> prior to issuance of building permits. <br /> 12. Interior Noise Levels: Interior noise levels for housing proposed to be located in areas <br /> exposed to an exterior noise level of an Ldn above 60 dB shall be maintained at or below <br /> an Ldn of 45 dB.
