Response to Spec fc Mountain House Master Plan/Specific Plan 1 Environmental <br /> Program Requirements prepared by Condor Earth Technologies, Inc. February 14, 2002 <br /> (Project No. 24961), <br /> Timing: Improvement Plans shall be checked by CCD and County Environmental Health <br /> Department. Corrective actions shall be taken prior to the recordation of a Final Map or <br /> the issuance of a crading permit for the affected area, whichever occurs first. <br /> BIOLOGICAL RESOURCES <br /> Participation in HCP: The developers of the Tentative Map shall request coverage <br /> under the SJMSCF', and the project applicants shall pay the SJMSCP impact fees as <br /> determined by SJC OG during the application and review process for the project, if said <br /> fees have not beer previously paid. <br /> 11. Pre-Construction Survey: A pre-construction survey consistent with the requirements of <br /> the San Joaquin County Multi-Species Habitat Conservation and Open Space Plan <br /> (SJCMSCP), Master Plan Appendix 7-C, and protocols established by State and Federal <br /> wildlife agencies shall be conducted within two calendar weeks prior to ground disturbance <br /> to cover kit fox as well as the remainder of the covered species. The pre-construction <br /> survey shall be conducted by a qualified biologist. All applicable Incidental Take Avoidance <br /> Measures described in Section 5.2 of the SJCMSCP and the pre-construction survey shall <br /> be implemented. <br /> Timing: The applicant shall submit a biologist's report of pre-construction surveys to the <br /> San Joaquin County Community Development Department (SJCCDD) and implemental all <br /> applicable take avo dance measures prior to the issuance of grading permits for the project. <br /> 2g. Endangered Species Act: In carrying out the operations of this project, the developer <br /> shall take no action that violates the Federal Endangered Species Act or the California <br /> Endangered Species Act or any other laws pertaining to the protection of listed animal <br /> and plant species. Compliance with said laws shall be the sole responsibility of the <br /> developer, who agrees to indemnify, defend and hold the County harmless from and <br /> against any claim or action by affected federal or state agencies or other third party as to <br /> the project's compliance with said laws. <br /> Timing: Improvement plans prior to final maps and ongoing. <br /> 23. Wetlands Protection: The applicant shall retain a qualified biologist or wetlands <br /> specialist to stake, using easily-observable flagging, the boundaries of all wetlands to be <br /> protected. The applicant shall organize and convene pre-construction conferences <br /> between the contra-;tor and the project biologist or wetlands specialist to ensure that <br /> grading contractors recognize the importance of these resources and avoid all flagged <br /> areas <br /> Timing. Temporary Construction Emissions: Implement the latest version of the SJVAPCD <br /> construction-emissions control measures during construction. <br /> 25.
