GLOSSARY OF TERMS AND ACRONYMS <br /> actual knowledge-the knowledge actually possessed by an individual who is a real person, rather than an <br /> entity. Actual knowledge is to be distinguished from constructive knowledge, that is, knowledge imputed <br /> to an individual or entity. <br /> adjoining properties - any real property or properties the border of which is contiguous or partially <br /> contiguous with that of the property, or that would be contiguous or partially contiguous with that of the <br /> property but for a street, road, or other thoroughfare separating them. <br /> antecedent environmental liabilities - Liabilities that arise from a problem that is solely the result of a <br /> previous third party's activities, and yet attach to a subsequent owner and/or operator of a property. <br /> appropriate inquiry - that inquiry constituting "all appropriate inquiry into the previous ownership and <br /> uses of the property consistent with good commercial or customary practice" as defined by CERCLA, 42 <br /> USC § 9601 (35XB), that will give a party to a commercial real estate transaction the innocent landowner <br /> defense to CERCLA liability(42 USC § 9601(A)and(B)and 9607(b)(3), assuming compliance with the <br /> other elements of the defense. <br /> AST- aboveground storage tank <br /> ASTM- American Society for Testing and Materials <br /> ASTM Phase I ESA - Phase I Environmental Site Assessment <br /> CAL-SITESIASPIS-California Hazardous Waste Sites Information System <br /> CaIEPA-California Environmental Protection Agency <br /> CERCLA - Comprehensive Environmental Response Compensation and Liability Act - Also known as <br /> the Superfund Act, CERCLA is the major Federal law governing investigation and cleanup of abandoned <br /> hazardous waste sites. <br /> CHMIRS- California Hazardous Material Incident Reporting System <br /> commercial real estate- any real property except a dwelling or property with no more than four dwelling <br /> units exclusively for residential use ( except that a dwelling or property with no more than four dwelling <br /> units exclusively for residential use is included in the term commercial real estate when it has a <br /> commercial function, as in the building of such dwellings for profit). The term commercial real estate <br /> includes but is not limited to undeveloped real property and real property used for industrial, retail, office, <br /> agricultural, other commercial, medical, or educational purposes;property used for residential purposes <br /> that has more than four residential dwelling units; and property used for residential purposes that has <br /> more than four residential dwelling units; and property with no more than four dwelling units for <br /> residential use when it has a commercial function,as in the building of such dwellings for profit. <br /> CORTESE- Identified Hazardous Waste and Substances Sites List <br /> County- Hazardous Materials Division of San Joaquin County Health Department <br /> CVRWQCB- Central Valley Regional Water Quality Control Board <br />
