That the cancellation is consistent with the purposes of the Williamson Act. <br /> a. The cancellation is for land on which a Notice of Nonrenewal las been served pursuant to <br /> Section 51245 of the Government Code. <br /> This subfinding can be made because the Community Developneent Department <br /> approved a Notice of Nonrenewal on July 5, 2007. <br /> b. The cancellation is not likely to result in the removal of adjacent lands from agriculturai use. <br /> This subfinding can be made because only 1.44 acres of land containing an existing <br /> single-family residence and an agricultural building is to come out of contract, and the <br /> removal of adjacent lands from agricultural use will not likely result from this request. <br /> c. The cancellation is for an alternative use which is consistent with the applicable provisions of <br /> the County General Plan. <br /> This subfinding can be made because a single-family residence and an agricultural <br /> building are permitted uses in the AG-40 zone, and are consistent with the AIG <br /> (General Agriculture) General Plan Designation. <br /> d. The cancellation will not result in discontiguous patterns of urban development. <br /> This subfinding can be made because this cancellation will not result in,or encourage, <br /> urban development. <br /> e. There is no proximate noncontracted land which is both available and suitable for the use <br /> which is proposed the contracted land be put, or, development of the contracted land would <br /> provide more contiguous patterns of urban development than development of proximate non- <br /> contracted land. <br /> This subfinding can be made because a residence and agricultural building exist on <br /> the parcel and are on property under contract. <br /> San Joaquin County PA-07005721Cortopassi Farms <br /> Community Development Page 6 <br />
