TULLY RD <br /> LOCKEFORD, CA 95237-0809 <br /> (209) 727-5035 FAX (209) 727-5204 <br /> ' November 9, 2021 <br /> Mr. Jeffrey Woods <br /> Lockeford Land Group LLC <br /> 3925 Old Santa Rita Road#200 <br /> Pleasanton, CA 94588 <br /> Re: Water and Sewer Will-Serve Capacity for Lockeford Vista Subdivision <br /> Dear Mr. Woods: <br /> This letter responds to your request to the Lockeford Community Services District ("District") <br /> for a will-serve letter for the subdivision or project described as shown and described in more <br /> detail on maps on file in the District office (the "Project"). The Project property is located within <br /> the boundaries of the District. <br /> As of the date of this letter, the District has sufficient untreated water supplies and sewer <br /> capacity available for the projected consumptive and fire protection demands of the Project. To <br /> permit the District to make a firm untreated water and sewer service commitment to the Project <br /> in the approximate amount requested, the developer will be required at its sole cost to construct <br /> and install all necessary on- and off-site improvements and comply with all applicable District <br /> ordinances, resolutions, rules, regulations, and policies, and state and other local laws, including <br /> Ordinances 13-02 and 16-02. <br /> Firm service commitments by the District to parcels requiring an extension of District facilities <br /> are provided only by a facilities extension agreement negotiated between the District and the <br /> applicant. The District and developer have entered into a facilities extension agreement dated <br /> November I , 2021. Service extensions, new service connections and service to the Project <br /> would be subject to the terms of the facilities extension agreement as well as then-applicable <br /> District ordinances, resolutions, rules, regulations, policies, and fees and charges. <br /> This letter is only a statement of the District's capacity conditions and ability to serve the Project <br /> as of the date set forth above, is specific to the Project, and is issued solely for the benefit of <br /> Lockeford Land Group, LLC and its potential assignee LGI Homes-California, LLC, subject to <br /> compliance with section 21.7 of the facilities extension agreement described above. This letter <br /> may not be transferred or assigned to any other party (e.g., landowner or developer), property or <br /> project without the District's prior written consent. This letter is not a contract, offer to contract, <br /> or binding commitment to provide water service or to reserve capacity to or for the Project. <br /> {00258058.11 1 <br />
