11 <br />U <br />Findin s <br />1. The proposed use is consistent with the goals, policies, standards, and nrcps of the General Plan, <br />any applicable Master Plan, Specific Pian, and Special Purpose Plan, and any other applicable plan <br />adopted by the County. <br />The establishment, maintenance, and operation of the use does not conflict With the <br />General Plan because a winery (Use Type: Agricultural Processing -Food Manufacturing) is <br />consistent with the AIG General Plan designation and may be conditionally permitted In <br />the AG -40 zone with an approved Use Permit <br />2_ Adequate utilities, roadway improvements, sanitation, water supply, drairoge, and other necessary <br />facilities have been provided, and the proposed improvements are properly related to eAsting and <br />proposed roadways. <br />The project must comply with the Department of_Transportation`s canditions that. require <br />the applicant to comply with commercial driveway standards for commercial uses with w <br />direct access onto state highways. The winery is also subject to obtaining discharge <br />requirements from the California Regional Water Quality Control Board,. Central Valley <br />Region. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be l <br />injurious to the property or improvements of adjacent properties. <br />This finding can be made because the initial Study .prepared for this project found no <br />�- �- potentially significant environmental. impacts. Jhe.Dep.ariment.of Public Works and the — <br />Department of Transportation have reviewed the:proposedproject and -did not deternttne <br />any potential safety issues associated with the amount of;traffic fibs winery woulHd �z_ <br />generate. As mentioned previously, the Department of Public Health Services will regulate <br />all septic, well, and drainage issues, and the California Water Quality Control Board will <br />regulate waste discharge which occurs as a result of the winery. <br />5. The use is compatible with adjoining land uses. <br />This finding can be made because, with the Conditions of Approval, the proposed use will <br />not interfere with or alter the current uses on adjacent properties which are either <br />agriculturally or residentially developed. There are a variety of agriculturally based <br />commercial businesses (wineries, produce stands, etc.) along State Route 88 between <br />Loekeford and Clements. Mokelumne Rivers Partners, a winery located one-quarter ('/4) of <br />a mile west of the newly proposed winery, has submitted a letter of support and <br />encouragement for the development of this winery. <br />
