Wilcox Road#H <br /> Stockton, CA 95215 <br /> PROPOSED CHOCOHOLICS FACILITY, SAN JOAQUIN COUNTY <br /> Thank you for calling both Tim O'Brien and myself today to discuss our 30 May 2003 letter requesting <br /> additional information to complete your Report of Waste Discharge (RWD) for your new facility in <br /> ' Clements. Your initial RWD contained a two-paragraph description of your facility and a$400_ filing <br /> fee. <br /> You requested several times that this agency"exempt" this discharge of waste as it is "too small" to <br /> warrant our attention. However, this agency has no legal mechanism to do that at this time. Once you <br /> submit the complete RWD, then staff will be able to evaluate your proposed discharge and either prepare <br /> waste discharge requirements (WDRs) or, if the discharge conforms to the requirements of Section <br /> 13269 of the California Water Code, a waiver of WDRs. However, we cannot make this determination <br /> without the information requested. <br /> You asked that staff inspect your current facility so that we can see that you have a small operation. As I <br /> explained, an inspection of your current facility will not provide the data required in our 30 May 2003 <br /> letter. For example, an inspection will not provide the chemical characterization of the wastewater, the <br /> flow rate calculations, information about existing groundwater quality, or information showing how your <br /> proposed discharge will not impact groundwater. In addition, our file already contains pictures from the <br /> 1 March 2003 Chesney Consulting report, showing a chocolate kettle, chocolate spilled on the floor near <br /> a drain, and a pipe discharging what appears to be chocolate waste to a floor drain. Once we have <br /> received and reviewed your RWD, staff may schedule an inspection if we have additional questions that <br /> can only be answered by a site visit. <br /> The annual filing fee is based on the threat and complexity of the wastewater discharge,as described <br /> Section 2200, Title 23, California Code of Regulations. At this time, staff has assessed a threat and <br /> complexity of 2B,based on a limited knowledge of your operations.
