In order to respond to
the issues raised in your letter, outlined below is a brief summary of the EHD involvement in your
project,as well as a response to each'ofyour specific questions.
➢ On September 27, 2002, the San Joaquin County Community Development Department(CDD)
sent referral letters requesting comments or recommendations on PA-0200428 (SA) to 24
agencies and interested parties. Included in those were referrals to the EHD and to the Central
Valley Regional Water Quality Control Board (CVRWQCB). The project was described as"A
Site Approval for a chocolate manufacturing and distribution facility. To include remodel of
existing 3,600 square feet[sic]building for retail store and office and adding 12,600 square foot
manufacturing and warehouse building."'
The CVRWQCB responded to the CDD referral by letter dated October 21,2002,with copies to
you and Mr. Frank Giannecchini. The letter noted, "Food manufacturing generates high strength
wastewater that is not suitable for discharge to a septic tank system. Because wastewater will be
generated from an industrial process, Waste Discharge Requirements (WDRs) will be required
for the discharge of wastewater at the site_" Submission of a Report of Waste Discharge(RWD)
was required at least 120 days prior to the start of any discharge of wastewater at the site.2
➢ On October 29, 2002,the EHD responded to the CDD referral with a letter listing the pertinent
San Joaquin County Development Title and California Health and Safety Code requirements for
your project. The standard conditions listed are under the jurisdiction of the EHD and must be
.approved prior to issuance of building permits for a project. These requirements included-
performance of a soil-suitability study,a nitrate loading study and percolation tests in the
proposed on-site wastewater disposal area. Written confirmation from the public water purveyor
that the project would be served by the public water system was required,as well as food facility
plans for the retail operation.
' See Attachment I: CDD Application Referral
2 See Attachment 2: Letter from Timothy O'Brien, Waste Discharge to Land Unit,CVRWQCB,dated October 21,
2002,
3 See Attachment 3: Land Use Condition Letter from Ray Borges,Lead Senior REHS,dated October 29,2002.
