PLANNING COMMISSION MINUTES <br /> JUNE 20, 1991 <br /> 5 . MINOR SUBDIVISION APPLICATION NO MS-91-78 OF LOIS MEIER (C/O <br /> MONTE SEIBEL) : An appeal by Lois Meier of staff ' s denial of <br /> a Minor Subdivision application to create a 2 . 0-acre homesite <br /> parcel and a ± 23-acre remainder. Located on the east side of <br /> State Route 88 , 2350 feet south of Buena Vista Road, north of <br /> Clements (Supervisorial District 4) . <br /> Chandler Martin, Associate Planner, introduced the staff report <br /> into the record. <br /> Chet Davisson, Director, said that Board Resolution No. R-88-1200 <br /> states in what manner the Planning Director is able to approve <br /> private rights-of-way. The first 300 feet of the private road <br /> which joins State Route 88 to the northerly and southerly access <br /> roads serve more than six parcels, and that is why the application <br /> was denied. The decisions of the Planning Director are appealable <br /> to the Planning Commission, and that is why this item is before the <br /> Commission. However, the Planning Commission does not have any <br /> more authority than the Director to approve this right-of-way for <br /> more than six parcels. The Board has a different degree of <br /> discretion on whether to approve a right-of-way for more than six <br /> parcels. <br /> PUBLIC HEARING OPENED: <br /> PROPONENTS: Monte Seibel, representing the applicant, said the Y <br /> property is a 25-acre vineyard. The owner plans to construct a <br /> home, but it is very difficult to get financing on 25 acres. The <br /> bank would prefer to finance a two-acre parcel for a homesite. <br /> When the vineyard was planted, the area on the high point was not <br /> planted and was reserved for a homesite on the 25 acres. They are <br /> aware of the restriction of access on the northerly road, and their <br /> intent is not to use that road. The road to the south is a better <br /> road, and that is their point of access to their property. They <br /> would be increasing the number of parcels on the southerly road <br /> from three to four parcels. They have 40 feet of easement. The <br /> only portion of the road that has more than six parcels using it is <br /> the 300 feet coming in, and that is an easement owned by the <br /> property to the north. <br /> Greg Lewis said he is half owner of the property and farms those <br /> vineyards. He uses the southerly road often, and there is not that <br /> much traffic on it. The area where the roads come together has <br /> good visibility. <br /> OPPONENTS: C. Edward Jones (25130 North Highway 88) owns a parcel <br /> to the east of Parcel A. His parents used to own all this <br /> property. More than six parcels now use the access road.
