PLANNING COMMISSION MINUTES JUNE 20, 1991 5 . MINOR SUBDIVISION APPLICATION NO MS-91-78 OF LOIS MEIER (C/O MONTE SEIBEL) : An appeal by Lois Meier of staff ' s denial of a Minor Subdivision application to create a 2 . 0-acre homesite parcel and a ± 23-acre remainder. Located on the east side of State Route 88 , 2350 feet south of Buena Vista Road, north of Clements (Supervisorial District 4) . Chandler Martin, Associate Planner, introduced the staff report into the record. Chet Davisson, Director, said that Board Resolution No. R-88-1200 states in what manner the Planning Director is able to approve private rights-of-way. The first 300 feet of the private road which joins State Route 88 to the northerly and southerly access roads serve more than six parcels, and that is why the application was denied. The decisions of the Planning Director are appealable to the Planning Commission, and that is why this item is before the Commission. However, the Planning Commission does not have any more authority than the Director to approve this right-of-way for more than six parcels. The Board has a different degree of discretion on whether to approve a right-of-way for more than six parcels. PUBLIC HEARING OPENED: PROPONENTS: Monte Seibel, representing the applicant, said the Y property is a 25-acre vineyard. The owner plans to construct a home, but it is very difficult to get financing on 25 acres. The bank would prefer to finance a two-acre parcel for a homesite. When the vineyard was planted, the area on the high point was not planted and was reserved for a homesite on the 25 acres. They are aware of the restriction of access on the northerly road, and their intent is not to use that road. The road to the south is a better road, and that is their point of access to their property. They would be increasing the number of parcels on the southerly road from three to four parcels. They have 40 feet of easement. The only portion of the road that has more than six parcels using it is the 300 feet coming in, and that is an easement owned by the property to the north. Greg Lewis said he is half owner of the property and farms those vineyards. He uses the southerly road often, and there is not that much traffic on it. The area where the roads come together has good visibility. OPPONENTS: C. Edward Jones (25130 North Highway 88) owns a parcel to the east of Parcel A. His parents used to own all this property.
