PC: 6-20-91 <br /> MS-91-78 <br /> STAFF ANALYSIS <br /> BACKGROUND <br /> On February 25, 1986, the Planning Division approved Minor Subdivision No. MS-86-48 subject to the <br /> condition that the access road be improved to public roadway standards. This subdivision created the <br /> subject property and three other parcels. On February 28, 1986, Tucker Barth appealed the requirement <br /> to improve the access road to public roadway standards. On April 17, 1986, the Planning Commission <br /> denied the appeal and modified some of the conditions of approval. The Planning Commission's denial <br /> was appealed to the Board of Supervisors. On May 22, 1986, the Board of Supervisors approved the <br /> appeal to remove the condition that a road built to Public Works standards be required. <br /> On April 24, 1991, the Development Services Division denied this subdivision (MS-91-78) because the <br /> tentative map is in conflict with Board Resolution No. R-88-1200. <br /> On May 6, 1991, Lois Meier (c/o Monte Seibel) appealed staffs denial to the Planning Commission. <br /> BOARD RESOLUTION NO. R-88-1200: <br /> Section 9-9380 of the Planning Trtle establishes minimum standards for access to parcels. Subsection <br /> (c) states: <br /> 'Parcels of land created by minor subdivision which because of existing improvements, <br /> physical conditions, or other unique circumstances cannot have frontage may be created, <br /> provided, however, that each lot so created is provided with a twenty-five (25) foot wide <br /> strip of land joined to the parcel it serves and further provided that the design is such that <br /> said access strips may be combined into fifty (50) foot wide roadways when required by <br /> future development.' <br /> The section goes on to state: <br /> 'Parcels created under this Section shall be required to make an irrevocable offer of <br /> dedication of said strip of land for roadway purposes and may be required to make an <br /> irrevocable offer to dedicate and improve said strip of land on demand of the County as <br /> a condition of approval of the map. When maps are approved under this Section, the <br /> approving body shall make appropriate findings to justify the necessity for the access <br /> method used.' <br /> Board Resolution No. R-88-1200 (attached) establishes the minimum standards and requirements for <br /> private rights-of-way which provide access to parcels created under the above Section. Paragraph (c) <br /> states: <br /> 'if a new parcel is being created, a maximum of six existing and/or potential lots may be <br /> served.' <br /> -7- <br />
