State law requires <br /> that land use within airport areas of influence must conform to the Airport Land Use Plan. <br /> The location of the proposed General Plan application to change the General Plan from Rural <br /> Residential (RIR) to Very Low Density Residential (R/VL) on three parcels totaling three acres, <br /> and a Zone Reclassification application to change the Zone Reclassification from Rural <br /> Residential (R-R) to Very Low Density Residential (R-VL) on three parcels totaling 3 acres, <br /> (APN/Address: 248-410-01; 8472 W. Fairoaks Road, Tracy).falls within the Horizontal Zone of <br /> the Tracy Airport's Area of Influence. Few restrictions are necessary for projects that fall within <br /> this zone. However, development on this land must adhere to the standards outlined in the <br /> 1993 amended Airport Land Use Plan. The standards pertinent to this zone includes, but are <br /> not limited to, the following: <br /> ➢ The use of non-reflective materials, transmissions, and visual distractions to pilots; <br /> ➢ Radio transmissions that would interfere with aircraft communications/navigation are not <br /> permitted; <br /> Residential uses are permitted if insulated to reduce interior noise to a level no higher than 45 dB; <br /> ➢ A Deed of Avigation and Hazard Easement is recorded in favor of the Airport Operator when new <br /> residential land use involved 5 or more units; and <br /> Proposed schools that are to be located within a 2-mile radius of an airport must undergo a <br /> review by Caltrans Division of Aeronautics and the State Department of Education. <br /> In addition, the property owner should be aware of the potential need to file FAA f=orm 7460-1 <br /> entitled Notice of Proposed Construction or Alteration.
