State law requires that land use within airport areas of influence must conform to the Airport Land Use Plan. The location of the proposed General Plan application to change the General Plan from Rural Residential (RIR) to Very Low Density Residential (R/VL) on three parcels totaling three acres, and a Zone Reclassification application to change the Zone Reclassification from Rural Residential (R-R) to Very Low Density Residential (R-VL) on three parcels totaling 3 acres, (APN/Address: 248-410-01; 8472 W. Fairoaks Road, Tracy).falls within the Horizontal Zone of the Tracy Airport's Area of Influence. Few restrictions are necessary for projects that fall within this zone. However, development on this land must adhere to the standards outlined in the 1993 amended Airport Land Use Plan. The standards pertinent to this zone includes, but are not limited to, the following: ➢ The use of non-reflective materials, transmissions, and visual distractions to pilots; ➢ Radio transmissions that would interfere with aircraft communications/navigation are not permitted; Residential uses are permitted if insulated to reduce interior noise to a level no higher than 45 dB; ➢ A Deed of Avigation and Hazard Easement is recorded in favor of the Airport Operator when new residential land use involved 5 or more units; and Proposed schools that are to be located within a 2-mile radius of an airport must undergo a review by Caltrans Division of Aeronautics and the State Department of Education. In addition, the property owner should be aware of the potential need to file FAA f=orm 7460-1 entitled Notice of Proposed Construction or Alteration.
