CONDITIONS OF APPROVAL <br /> PA-0500157 <br /> VR.IELING FAMILY TRUST <br /> Minor Subdivision Application No. PA-0500157 was approved by the San Joaquin County <br /> Community Development Department on May 24, 2005. The effective date of approval is June 3, <br /> 2005. This tentative map approval will expire on June 2, 2008, which is three years from the <br /> effective date of approval, unless (1) all Conditions of Approval have been complied with and (2) a <br /> Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Karla Kuhl, 468-3103 ) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved <br /> tentative map dated April 11, 2005. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the <br /> following note shall be placed on the Parcel Map: <br /> 1) All persons purchasing lots within the boundaries of this approved map <br /> should be prepared to accept the inconveniences or discomforts associated with <br /> agricultural operations or activities, such as noise, odors, insects, dust or fumes. <br /> San Joaquin County has determined that such inconveniencies or discomforts shall <br /> not be considered to be a nuisance. <br /> c. HOMESITE PARCELS LOT SIZE AND WIDTH: The following lot size and <br /> width regulations shall apply to this map: <br /> 1) Parcel 1 (Homesite parcel) shall have a minimum lot width of 150 feet. <br /> (Development Title Section 9-610.4). <br /> 2) Parcel 1 shall be between two (2) net acres and five (5) gross acres in size. <br /> (Development Title Section 9-610.3[a]) <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a <br /> Notice of Minor Subdivison Restriction shall be recorded concurrently with the <br /> Parcel Map, with a reference to the instrument number of said recorded <br /> Notice, stating that: <br /> 1) The homesite parcel shall not be transferred until (10 years <br /> from the date of approval), or upon the death of an owner <br /> owning at least fifty (50) percent interest in the homesite parcel. <br /> 2) The property shown on the Parcel Map is restricted from <br /> further subdivisions for homesite purposes, except for financing <br /> only, by Section 9-610.3 of the San Joaquin Development Title. <br />
