The Federal Clean Air Act (CAA) and the California Clean Air Act require <br /> areas that are designated nonattainment to reduce emissions until standards are met. <br /> Based on the information provided, it appears that this project will have a less-than- <br /> significant impact on the ambient air quality. Therefore, a negative declaration is <br /> appropriate from an air quality perspective. However, the construction phase of this <br /> project can generate emissions from the movement of soil, use of heavy equipment, <br /> bulk materials handling, asphalt paving and other related activities. As a result, this <br /> project is subject to District Regulation VIII (Fugitive Dust Prohibitions). The purpose of <br /> Regulation VIII is to reduce the amount of fine particulate matter (PM-10) entrained into <br /> the ambient air from man-made sources. The attached Synopsis highlights many of the <br /> requirements contained within Regulation VIII. The Synopsis is not meant to be all- <br /> inclusive, but it can be a useful compliance aid in the field and office alike. <br /> According to the Site Approval Application, the applicant states that vegetation on site, <br /> namely weeds, are either disced or burned annually. Only commercial farming <br /> operations with a valid District agricultural permit are allowed to burn vegetative <br /> material. Burning without a valid agricultural permit is a violation of District Rule 4103 <br /> and is subject to possible enforcement action by our compliance division. <br /> This project may be subject to the permitting requirements of the District.
