4. APPEAL OF SITE APPROVAL NO. SA-01-75 OF RICHARD &LYNDA STAGNO: An appeal by the <br /> City of Lathrop of the Community Development Department's approval of a Site Approval application to <br /> establish an animal feed lot for a maximum of 500 swine (Use Type: Animal Feeding and Sales). The <br /> project site is located on the south side of Frewert Road, 4600 feet west of Interstate 5, west of Lathrop <br /> (Supervisorial District 3). This item is continued from the meetings of March 7 and May 2, 2002,with <br /> the hearing open. <br /> Jennifer Jolley, Associate Planner, introduced the staff report into the record. <br /> PUBLIC HEARING OPENED: <br /> APPELLANT: <br /> Bruce Coleman, Director of the Community Development Department of the City of Lathrop, said the City is <br /> opposed to this project. They have filed with LAFCO to put this site and the surrounding area into their <br /> sphere of influence. He requested that a Specific Plan be done for this site. He said there is a site south of <br /> this project that is proposed for residential development, and they are concerned about the impacts of this <br /> project on the residential development. Also, there are homes in the area that would be impacted. An <br /> environmental determination should not be made until the soil and nitrate studies have been completed. <br /> They have concerns about the disposal of manure and the contamination of water and air pollution. <br /> Mitigation should be done for these issues. The environmental review is not adequate. There are <br /> inadequate sanitation facilities. There has been no real analysis of the traffic impacts. Because of the <br /> number of animals involved,this looks more like animal raising, so they think a Use Permit should be <br /> required. <br /> Bonnie Wassmer said the residents of Lathrop are opposed to this project. They have concerns about <br /> odors, the manure problems, and the future growth of Lathrop. <br /> OPPONENTS TO APPEAL: <br /> Don Moyer(P. O. Box 207, Ripon), representing the Stagno Meat Company, said the County has said they <br /> support agriculture. That is why farming operations are exempt from the odor and noise issues. He agrees <br /> with all of the conditions. They will do another manure study. They have done water studies. They will <br /> continue to try to come to some sort of compromise with Lathrop, but they wish to continue forward with this <br /> operation. This is an agricultural use in an agricultural zone. <br /> Commissioner Stockar asked if these pigs are going to be small roasters. <br /> Don Moyer said that about 350 of the 500 pigs would be roasters. <br /> REBUTTAL: <br /> Bruce Coleman said he has already discussed their issues. <br /> PUBLIC HEARING CLOSED: <br /> MOTION: <br /> It was moved, seconded (Stockar/Eley), and passed by a unanimous roll call vote (6-0)to deny the appeal. <br /> PC MINUTES PC: 7-11-02 <br />
