Analysis <br /> Background <br /> On January 31, 2002, the Community Development Department approved Site Approval Application No. <br /> SA-01-75. On February 11, 2002, the City of Lathrop appealed the Community Development's approval of <br /> this application. <br /> Appeal Statement No. 1: <br /> In its appeal, the City of Lathrop stated: <br /> "Inadequate environmental review under the California Environmental Quality Act("CEQA")" <br /> Response to Appeal Statement No. 1: <br /> The Community Development Department prepared an Initial Study on October 3, 2001, and posted a <br /> Negative Declaration on October 8, 2001, The Initial Study found that the project would not have a <br /> significant effect on the environment. <br /> Appeal Statement No. 2: <br /> In its appeal, the City of Lathrop states: <br /> "Improper delay of numerous studies related to sensitive receptors, discharge requirements, noise, <br /> waste disposal and traffic impacts." <br /> Response to Appeal Statement No. 2: <br /> Discharge Requirements: The California Regional Water Quality Control Board (C.R.W.Q.C.B.) regulates <br /> waste discharge requirements. The Board reviewed this project and found it to be in compliance with Waste <br /> Discharge Requirements Order No. 99-134, which addresses the management of animal waste(see memo <br /> dated January 18, 2002). <br /> Noise. Noise impacts were considered to be less than significant. Pursuant to Development Title Section 9- <br /> 1025.9(c 15]), noise sources emanating from any agricultural operation, including activities associated with <br /> the processing or transportation of crops when such activities are conducted on agriculturally zoned lands, <br /> shall be exempt from the provisions of the chapter(Performance Standards, Chapter 1025). This project is <br /> an agricultural operation. <br /> Waste Disposal: The Environmental Health Department's Condition of Approval No. 3.A. requires that a soil <br /> suitability/nitrate loading study be prepared. The study will determine that the area is suitable for handling <br /> the amount of animal waste generated by the number of swine proposed. Development Title Section 9- <br /> 1105.2(d) states, "The suitability of an area proposed for septic tank usage shall be determined prior to <br /> submission of a General Plan Amendment or Zone Reclassification application, the approval of a parcel <br /> map or final map, or the issuance of a building permit for other development project applications." <br /> In this case, the Environmental Health Division is requiring that the study be prepared and approved prior to <br /> issuing a building permit. <br /> San Joaquin County SA-01-75\Stagno <br /> Community Development Page 3 <br />
