UP-99-22 OF <br /> RICHARD AND LYNDA STAGNO <br /> (THIRD SUPERVISORIAL DISTRICT) <br /> IT IS RECOMMENDED: <br /> That the Board of Supervisors deny the appeal. <br /> BACKGROUND: <br /> On February 2, 1995, the Planning Commission voted unanimously to approve Use Permit No. UP-94-14 <br /> for a wholesale slaughterhouse proposed at the subject location. This Use Permit permitted the <br /> slaughter of up to 50 animals per day. The approval was appealed to the Board of Supervisors by the <br /> City of Lathrop, Larry Matlock, and Bennie Gatto. On April 25, 1995, the Board of Supervisors adopted <br /> Resolution No. R-95-198 to deny the appeal and approve the Use Permit. On December 19, 1996, the <br /> Planning Commission approved a one-year Time Extension to October 24, 1997. The Conditions of the <br /> Use Permit were not met in time, and the approved Use Permit expired and became void. <br /> The subject Use Permit, UP-99-22, is for the renewal and expansion of the previous Use Permit. The <br /> expansion includes a somewhat larger 6,700 square foot abattoir, a 4,000 square foot freezer, and the <br /> slaughter of 500 animals a day. <br /> The Planning Commission heard this matter at its meeting of January 6, 2000. <br /> After reviewing all written and oral testimony, a motion to deny the Use Permit based on the inability to <br /> make Findings 2, 3, 4, and 5 was moved and seconded. These Findings are as follows: <br /> • Finding 2 requires provision of adequate utilities and improvements including sanitation, <br /> water, and drainage; <br /> • Finding 3 ensures the site is physically suitable for the intensity of the development; <br /> • Finding 4 requires that the use will not be detrimental to public health and safety or injurious <br /> to adjacent properties; and, <br /> • Finding 5, which requires compatibility with adjoining land uses. <br /> The motion to deny the Use Permit passed with a 6-1 vote. <br /> On January 18, 2000, Richard Stagno appealed the Planning Commission's denial of the application. <br /> BOS LETTER PAGE 1 <br />
