BACKGROUND <br /> The RWQCB issued two letters entitled "Complaint Investigation-Norman's Nursery, Escalon <br /> Bellota Road , San Joaquin County, " dated September 6 , 1996 . In summary, the letter focused <br /> on water quality and included the statement that "tailwater discharge to Potter Creek poses a <br /> water quality problem , and we are currently working with the nursery to correct the situation . " <br /> Potter Creek has been used for irrigation tailwater discharge by Norman's Nursery in the past. <br /> The creek is located just north of the Nursery and flows in a westerly direction . Water samples <br /> were reportedly collected from five sampling points including Barbagelata Orchards test pit <br /> (tree removal hole) , Norman's Nursery "tailwater," and Potter Creek. The primary analyte of <br /> concern appears to be Nitrate as NO3, which reportedly was over drinking water standards in <br /> four of the five water samples. <br /> During a site visit by Kleinfelder on January 22, 1997 (and subsequent rainfall events ) , <br /> "significant amounts of stormwater runoff was flowing down drainages of the hills into the <br /> southeast corner of the nursery property, " (documented and photographs taken). Previous <br /> evidence of stormwater runoff was noted from erosion of these drainages . <br /> On September 25 , 1997 , the Central Valley Office of the State of California RWQCB issued <br /> Monitoring and Reporting Program No. 97-811 . That Monitoring and Reporting Program <br /> (MRP) required that surface water and rainfall monitoring begin immediately. The MRP also <br /> required a workplan for the installation of monitoring wells be submitted by October 30, 1997 . <br /> The groundwater monitoring was required to begin by December 1 , 1997 . <br /> The implementation of Kleinfelder's workplan , approved by the RWQCB , was detailed in <br /> Kleinfelder's report titled " Fourth Quarter 1997 Ground and Surface Water Monitoring . . . " <br /> dated January 28 , 1998 . <br /> Additional monitoring and pertinent activities are detailed in Kleinfelder's quarterly monitoring <br /> reports for the project.
