PLEP Requirement: For the purposes of the.Public Land Equity Program (P.LEP), the public land <br /> dedication requirement for the Tentative.Map is.0.92 acres(23.2% X 4.36 acres in the project) <br /> wherea's there is no actual amount of'qualifying PLEP public land on the subject.property. The <br /> resulting Public:Land Deficit is, therefore, 0:92 acres. The developer shall correct said Public Land <br /> Deficit if not previously co'rrected by using one or more of the following methods: 1) Dedicating <br /> Public Land.which is not on the shown on the Tentative Map but which is within the Mountain House <br /> Community to the Applicable Public Agency, sufficient in acreage to meet said Public Land-Deficit; 2) <br /> transferring fee title ownership,of Private Land which is not needed for public facilities or services but <br /> which is within the Mountain House Community to MHCSD, sufficient in acreage to meet said Public <br /> Land Deficit; and/or 3) submitting land vouchers to the MHCSD, sufficient in acreage to meet said <br /> Public Land Deficit. (Mountain House Development Title, Chapter 9-1245M regarding the Public Land <br /> Equity Program, and Chapter 9-110M regarding definitions for"Public Land Deficit", "Applicable <br /> Public Agency", "Private Land", and "land voucher".) <br /> Timing: Condition shall be satisfied prior to approval of the first Final Map, or as required by the <br /> Applicable Public Agency. <br /> AGRICULTURAL RESOURCES <br /> 15. Agricultural Operation Phasing: An Agricultural Buffer and Conversion Phasing Plan shall be <br /> submitted to the Community Development Department and approved by the Director. The plan shall <br /> incorporate the following: <br /> a. Phasing of areas from agricultural to urban use— locations and time frames; <br /> b. Irrigation water supply and service plan approved by BBID; <br /> c. BBID encroachment permits; <br /> d. Temporary buffering that includes a 100-foot setback (or as adjusted by condition 10) <br /> between the edge of development and ongoing agricultural operations as the project <br /> builds out; <br /> e. Permanent setbacks; <br /> f. Landscape buffers; and <br /> g. Fencing, signage or other suitable measures to minimize noise, spray drift and limit the <br /> potential for trespass on agricultural lands and BBID facilities. <br /> In addition, the plan shall address the following.- <br /> h. <br /> ollowing:h. Chemical applications; and <br /> i_ Dust management. <br /> Note: An exception to the requirements specified in (a), (d), (e), (f), (h), and (i) may be <br /> granted when the owner of such agricultural land has indicated in writing that the land will no <br /> longer be used for agricultural production. <br /> Timing: Condition shall be met prior to approval of the Final Map.
