42. Water Quality Basins Mosquito Abatement: Plans for the'implembntation and maintenance of the <br /> water quality basins and any other storm drainage facilities involving open bodies of water shall be. <br /> reviewed and approved by-the MHCSD and if,required,b} the MHCSb, reviewed by the mosquito <br /> Abatement District. Condition shall'be mettbefore approval of-first Final Map. <br /> 43. Utilities: <br /> A. The Developers and contractors shall comply with Ordina6c'e No. 4-162"Street Opening and <br /> Pavement Restoration Regulation's <br /> B. Any phased development shall install all"in-tract" utilities required to serve the development. In <br /> addition, if any future adjacent or nearby phases of the development, or adjacent Neighborhoods, <br /> will depend on obtaining service from such Utilities, then the utility lines shall'be' sized to serve <br /> these future developments. Any utility lines that are intended to be used by an.adjacent <br /> development.or Neighborhood shall be installed up to the phase or Tentative Map boundary line to <br /> make it available for future extension. To recoup all or a portion of any over sizing costs, the <br /> developer may request the MHCSD to process a reimbursement agreement pursuant to the <br /> MARA. <br /> C. When public utilities are to be located outside public rights-of.=way but within the Tentative Map <br /> boundary, the developer shall provide public utility easements for these utilities. The easements <br /> shall be shown on all Final Maps and parcel maps. <br /> D. Prior to the submittal of improvement plans for the development, the developer shall submit to the <br /> MHCSD composite schematic plans for in tract storm drains, sanitary sewers, and water <br /> distribution facilities. <br /> E. Electrical transformers within residential Neighborhoods shall be in underground vaults, subject to <br /> MHCSD and Modesto Irrigation District(MID) requirements. The developer shall pay for any <br /> incremental costs relating to undergrounding transformers not paid for by MID. Transformers <br /> located in the downtown area, commercial and industrial areas may be placed above ground <br /> provided they are aesthetically designed and/or shielded by landscaping subject to MHCSD and <br /> MID requirements. <br /> 44. Wastewater Treatment Plant: <br /> A. Under the direction of the MHCSD, the applicant shall fund, design and construct a phased <br /> expansion of the wastewater treatment plant(WWTP) of sufficient capacity, no less than 1.5 <br /> mgd, to serve Tract No. 3601 prior to issuance of the first building permit. Recognizing that <br /> there may be agreements between the developers for sharing capacity and also recognizing that <br /> the MHCSD is not a party to and has no control over such agreements, bonding for construction <br /> shall be provided prior to approval of the first final map and beginning of construction shall be at <br /> the discretion of the General Manager. Issuance of building permits shall cease if construction <br /> does not begin when directed by the General Manager. <br /> B. The developer shall extend existing pipelines to the project site as shown on the Master Sanitary <br /> Sewer Plan <br /> C. The Wastewater Treatment Plant expansion requirement as indicated above shall meet the <br /> requirements of the Regional Water Quality Control Board (RWQCB) effluent permits, including <br /> compliance scheduling, testing and any infrastructure that may be required for long-term <br /> discharge into Old River. Additional treatments that may be required by the RWQCB for such <br /> pollutants as dissolved solids, metals and heat, etc., shall be addressed in the plant expansion. <br /> Conditions of Approval -20 - PA-0700093 <br />
