This is consistent with the SPIII General Plan'and Zoning density for the property. The applicant is proposing to remove the riparian corridor, which is inconsistent with the General Plan and Zoning Land Use Maps and will require an amendment to these documents. The development plan is consistent with policies in Specific Plan III to create pedestrian walkways, as well as a rnix of housing types to meet affordable housing goals. The proposed project and densities are within the scope of the SPIHEIR and does not create any new impacts. Mitigation Measures No mitigation measures are required. c) Conflict with any applicable habitat conservation plan or natural community i conservation plan? The proposed project would not conflict with any adopted Habitat Conservation Plan,Natural Community Conservation Plan, or other approved conservation plan. The San Joaquin County Multi-Species Habitat Conservation and Open Space Plan(SJMSCP) has been prepared to provide a strategy for balancing the need to conserve agricultural lands and [( wildlife habitat while accommodating a growing population in the County. The SJMSCP is designed to establish an assessment process for conversion of land to non-open space uses when such conversion may affect the plant, fish, and wildlife species covered by the ; SJMSCP. i 1 Compliance with the SJMSCP will be met through the applicant's payment of the SJMSCP fee along with pre-construction surveys and "take" avoidance measures spelled out in the SJMSCP. The proposed project will comply with the requirements in the Riparian Habitat Ordinance. This ordinance requires a developer to protect existing riparian habitat(such as the drainage swale habitat at the proposed project site) or mitigate for the loss of the habitat. One method of mitigation is to contribute to existing off-site riparian habitat areas such as the Mountain House Creek corridor. Policies related to protection of other sensitive biological resources I (such as special status species)will be addressed through the applicant's participation in the SJMSCP. 4-50
