I <br /> Before the Board of Supervisors <br /> County of San Joaquin, State of California <br /> R- 06-783 <br /> RESOLUTION APPROVING SPECIFIC PLAN III AMENDMENT NO. PA-0600365 OF GOLDEN <br /> STATE INVESTMENTS II, LP FOR THE MOUNTAIN HOUSE NEW COMMUNITY. <br /> WHEREAS, on November 16. 2006, the San Joaquin County Planning Commission <br /> considered this matter; and <br /> WHEREAS, on December 12, 2006, this Board of Supervisors did conduct a public <br /> hearing on said matter, notice of said hearing having been given in accordance with law, and oral <br /> and documentary evidence having been received in favor of or opposed to said matter, and this <br /> Board of Supervisors being advised on the premises; and <br /> WHEREAS, this Board of Supervisors found that an Environmental Checklist("Checklist") <br /> was prepared for the project(included in Altamont Heights Project Staff Report Appendix 8). The <br /> Checklist concluded that: 1)the project is a subsequent activity that is within the scope of the <br /> Specific Plan III EIR(SPIIIEIR);2)there are no effects of the project that were not examined in the <br /> SPIIIEtR 3)and no new mitigation is required for the project.Consequently, as provided by CEQA <br /> Guidelines Section 15168(c), no new environmental document is required; and <br /> WHEREAS, this Board of Supervisors determined that said Specific Plan tit Amendment <br /> is consistent with the General Plan, the Master Plan, the Public Financing Plan and does not <br /> adversely affect the Jobs/Housing Program and housing affordability, and meets all applicable <br /> provisions of the Mountain House Development Agreement, based on the Bases for Specific Plan <br /> Amendment contained in the Allamont Heights Project staff report (Attachment"A"); <br /> NOW, THEREFORE, BE IT RESOLVED by this Board of Supervisors that: <br /> I <br /> i <br /> 1. Specific Plan III Amendment No. PA-0600365 is hereby approved by approval of the <br /> following: <br /> SPECIFIC PLAN III AMENDMENT NO. PA-0600365, with the Bases for Specific <br /> Plan Amendment and with said Specific Plan III Amendment attached hereto as <br /> Exhibit"A"and as Exhibit"B"respectively, and made a pari of this Resolution. <br /> i <br />
