This.approximately 12.75- <br /> acre site is located in Section 17, Township 2 South, Range 4 East, MDB&M, Latitude <br /> 037" 45' 7.47", Longitude 121° 33' 14.0", San Joaquin County, California. <br /> Based on available information, we concur with the estimate of waters of the United <br /> States, as depicted on the November 21, 2005 Figure 2 Project Site Golden State <br /> Investments 2, LP drawing prepared by EIP Associates. No waters of the United States, <br /> including wetlands, are present within the survey area. <br /> The water identified as the single Wetland Feature on the above drawing is an <br /> intrastate isolated water with no apparent interstate or foreign commerce connection. As <br /> such, this water is not currently regulated by the Corps of Engineers. This disclaimer of <br /> jurisdiction is only for Section 404 of the Federal Clean Water Aet. Other Federal, State: <br /> and local laws may apply to your activities. In particular, you may need authorization <br /> _ from the California State Water Resources Control Board and/or the U.S. Fish and <br /> Wildlife Service. <br /> This verification is valid for five years from the date of this letter, unless new <br /> information warrants revision of the determination before the expiration date. This letter <br /> contains an approved jurisdictional determination for your Golden State Investments 2, <br /> LP. If you object to this jurisdictional determination, you may request an administrative <br /> appeal under Corps regulations at 33 CFR Part 331. Enclosed you will find a Notification <br /> of Appeal Process (NAP) fact sheet and Request for Appeal (RFA) form.
