wa <br /> E <br /> F RECIEVED <br />{ <br /> 4313 DEC 2 7 X006 <br /> ORDINANCE NO. <br /> �i <br /> ,l Community Development Dept. <br /> AN ORDINANCE AMENDING THE ZONING MAP OF SAN JOAQUIN COUNTY IN <br /> ACCORDANCE WITH SECTION 9-105.6 OF THE ORDINANCE CODE OF SAN JOAQUIN <br /> COUNTY BY RECLASSIFYING PROPERTY IN SPECIFIC PLAN 111 WITHIN MOUNTAIN <br /> HOUSE, AS SHOWN ON THE ATTACHED MAP(EXHIBIT A). <br /> WHEREAS,on November 16, 2006, the San Joaquin County Planning Commission <br /> considered this matter; and <br /> F <br /> WHEREAS, on December 12,2006, this Board of Supervisors did conduct a public <br /> hearing on said matter, notice of said hearing having been given in accordance with law,and oral <br /> and documentary evidence having been received in favor of or opposed to said matter, and this <br /> Board of Supervisors being advised on the premises; and <br /> WHEREAS, this Board of Supervisors found that an Environmental Checklist("Checklist') <br /> was prepared for the project(included in Altamont Heights Project Staff Report Appendix 8).The <br /> Checklist concluded that: 1)the project is a subsequent activity that is within the scope of the <br /> Specific Plan III EIR(SPIIIEIR);2)there are no effects of the project that were not examined in the <br /> SPIIIEIR;3)and no new mitigation is required for the project. Consequently, as provided by CEQA <br /> Guidelines Section 15168(c), no new environmental document is required; and <br /> WHEREAS,this Board of Supervisors determined that said Specific Plan III Amendment <br /> is consistent with the General Plan, the Master Plan, the Public Financing Plan and will not <br /> adversely affect the Jobs/Housing Program and housing affordability and meets all applicable <br /> provisions of the Mountain House Development Agreement,based on the Bases for Specific Plan <br /> i Amendment contained in the Mountain House Business Park Project staff report; <br /> NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of <br /> I San Joaquin,State of California, do ordain as follows: <br /> I Section 1. The Zoning Map of the County of San Joaquin,as amended, is hereby further <br /> amended by replacing the P-F zone with the R-L zone and moving the road from the C-O zone <br /> area to the I-P zone area within Specific Plan 119, as shown on Exhibit"A"which is attached to, <br /> and made a part of,this Ordinance. <br /> Section 2. The Director of the Community Development Department shall revise the <br /> Zoning Map of the County of San Joaquin in accordance with Section 1 of this Ordinance. <br /> Section 3. This Ordinance shall take effect and be in force thirty(30)days after its <br /> adoption,and prior to the expiration of fifteen (15)days from the passage thereof, shall be <br /> published once (1) in The Record, a newspaper of general circulation published in the County of <br /> San Joaquin, State of California, with the names of the members of the Board of Supervisors <br /> voting for and against the same. <br /> c <br />
